Flight delay and cancellation compensation, Tui/Thomson ONLY

  • I am starting this thread for those claiming flight delay or cancellation compensation from Thomson.

    Any posts regarding any other airline in this thread will be ignored (at least by me).

    We were meant to depart at 07.05 from Gatwick. On arrival at 4.30 am we were informed there would be a 5 hour delay because the pilot had rung in sick at 9.30 the previous evening and as we were due to fly on a Dreamliner, which was already there, we were having to wait for a qualified pilot to come down from Manchester. We boarded the plane just after 12 noon and then had to wait for the plane to be refuelled. We eventually took off sometime after 12.30 not arriving until around 6 pm instead of early afternoon.

    I filled in the complaint form on the Thomson website and received a lengthy letter 28 days later almost identical to that of some other claimants claiming a technical fault to the incoming plane. Totally different story to the one already given to us and claiming Exceptional
    Circumstances.

    Do we have a legitimate claim and what should be our next course of action - bearing in mind we only had a week and lost almost a day and had two five year olds with us.

    Research this thread then take court action in accordance with instructions given throughout. Do not involve CAA and decide whether DIY or NWNF.

    Just wondered if anyone was on this flight which was delayed by approx 20 hours! My aunty and uncle were and wondered if anyone has had any luck claiming?

    Would you recommend sending the template letter and then proceeding immediately with small claims, or are Thomson ever likely to pay out without taking this action?

    You can try and see what happens. Some posters are getting paid out with one letter (not sure which airlines are better than others as far as that is concerend). There's no obligation to take further steps so get a letter sent and meanwhile read up the FAQs in case you need/want to take it further.

    This is my first ever forum so hope I get this right! I have received stock reply from Thomson saying they cannot consider claims over 2 years old, despite me referring to the ECJ ruling regarding the Cuandrench v KLM case. I have submitted this to CAA, but read with interest the post referring to a pending case relating to Dawson v Thomson. I assume this is to challenge the 2 year argument? Where can I read up on this?

    Looked at my on line claim this morning with a view to requesting judgement (28 days now up since Thomson filed acknowledgement of service) and the status has changed to
    "Your claim was transferred to LIVERPOOL on 28/02/2014"
    Does this mean Thomson has filed a defence or can I still request judgement as the 28 days are now up?
    Sorry if this seems like a silly question, just don't want to mess things up at this stage.

    Means that they may have filed a defence however you should not request judgement. Worth contacting Liverpool CC to see current state and reading Tom Gunn's recent post on here

    He was one of many cases heard yesterday - Monarch (again) failed to appear. Unsure if your case was actually heard yesterday (TG may be aware) however assuming Liverpool is out of your way you should put in a transfer request (back to your local court) stating why you cannot attend.

    Thanks for answering, 111KAB, I'm confused though!
    I've read Tom Gunn's comments but can't find any similarity to my case. I'm way behind him. Thomson filed acknowledgement of service on 30th January and since then I've heard nothing. I was going to request judgement today but thought I should check when I saw case had been transferred from Northampton to Liverpool (I live near Newcastle)
    You say my case may have been heard yesterday. Can this happen without me knowing anything about it?
