  • I'm claiming on a flight in July 2005. Written to Thompson they said no. Wrote to caa then Spanish aviation, they said was entitled to comp. write back to Thompson they still say no?? Can't tai to small claims as not in last 6 years?? What do I do next????

    I knew I would get help from one of the "experts" on this forum! I have phoned CCMCC and asked if I am correct that I'm not allowed to use tippex? I was! I'm now being sent new forms to complete but at least this time they will be correct! Oh well, just means I'm back to where I was 4 weeks ago!

    Not quite .... you should get an extra months interest - if you get 8% it is worth having!

    someone mentioned the cutoff for the Spanish courts is 10 years although I would expect the costs of taking the airline to court in Spain with lawyers and translators to not be worth the hassle - don't believe there are NWNF firms in Spain so you would need to fork out all the costs

    Today's rate is 82.3p or so so using 85p is beneficial albeit only by a small amount.

    I do not normally post on these type of forums but felt compelled to share my experience. After 8 months and many letters to and from Thomson regarding a cancelled and subsequent delay in the alternative flight - I completed an online small claims appeal - cost of £70 within 2 weeks Thomson emailed me to tell me my claim plus 8 months interest on compensation would be settled out of court- I am expecting a cheque for over £1300 in next few weeks. Thomson claimed exceptional circumstances as the fleet of planes did not arrive on time from manufacturer - it was a shame I ad to resort to such measures but after reading various forums felt this was now a matter of principle - seems we were right - this post is to encourage others to pursue wrong doing by thomson and claim what you are legally entitled to even if it means £70 initial outlay it was settled in no time

    I am at the point of waiting for Thomson to submit their defence (28 days up on Fri 28th Feb) So far I've heard nothing after their acknowledgement of service on 30th January.
    I intend to request judgement on 1st March but am slightly confused by the wording in the on-line link. It says
    "14 days must have expired since the claim was served on the defendant(s) (the claim is considered served on the fifth day after it was issued) and a response has not been filed or served on you"
    Am I doing the right thing in requesting judgement in this way?
