    thanks everyone for your help. I know I've left it last minute. I was waiting for results to come in and then I forgot I had to do a NBA and that delayed me again. The problem didn't hit me until I went online to do it yesterday and saw that there was no way of adding him to claim .
  • Just heard from Thomson to say we will be getting full compensation due to us of 600 Euros (£501.15) each for myself and my husband. We were delayed 5 hrs on our flight to Florida in June, at the time we were given £5 food/drinks voucher each which didn't cover breakfast! After one letter, half a dozen emails and a phone call last night to chase we got a great outcome and well worth the time/effort. Thank you Moneysavingexpert.com and Martin Lewis for all your advice on the site!! Advice to others - research what you're entitled to, use a template letter off Moneysavingexpert.com which you amend accordingly and stick with it.

    but it says:

    "Court judgments are available for the most senior courts, typically Court of Appeal decisions.

    If your case is against Thomson then you might want to reference Lawes v Thomson Airways Limited (3YM11541) which is a case they lost recently at Bedford County court.

    The circumstances were the same as in Jager, i.e. bad weather on a previous flight.

    The District Judge help that the wording in Recital 14 in the Preamble is quite clear that bad weather is only extraordinary if it is incompatible with the operation of the flight concerned.

    Unfortunately I don't yet have a copy of the Judgments in either Jager or Lawes.

    Thanks for your responses. I am claiming against Thomson and sent off my N1 last week.
    At the moment I have no idea why our flight was delayed in Jan 2011, in all the replies to my letters (7) T have either ignored the question or declined to give details. Consequently I am trying to get as much background on as many situations as possible.

  • Well, we had our case heard today and won! Thomson didn't even bother to turn up or submit a statement. Was sort of expecting that as we didn't even receive a bundle from them...

    No I didn't start legal proceedings within the two years. That is great customer service don't you think? We will only take notice of a claim and the law if you commence legal proceedings within the time frame. Complain all you want but that will not make a difference!

    I might be being a bit naive but where in 261/2004 does it say that you have to start legal proceedings to get compensation?
    I fully expect to have the 2 year "get out excuse/lie" thrown at me even though my first request for compo was within 2 months of the delayed flight.
    They have already tried it in their interminable cut and paste exercises.
