Thomson have stated that the delay was caused by a problem with the flap slat on the wing. Thomson also state that “this was a technical defect that doesn’t fall into the category of something that was or ought to have been discovered during routine maintenance.” Which case can i refer in my statement as im trying to do my bundle and am stuck on what else to include. I have included Wallentin, Sturgeon and Nelson case but can anyone point me to which part in particular i should refer to?0

In the end I used 'accept' not 'respect'
The letter is ready to post0 -
...Regarding 'respect' I can do nothing about Dawson and would like to stay in the good books of the judiciary!
It is interesting to note that the airlines and their solicitors would be the first to highlight any procedural errors that claimants make, i.e. that name isn't in the claimant box, therefore they aren't a claimant, so it is important that DJs should be aware of any procedural errors that may have taken place by airlines and/or their solicitors, that may affect your case and other subsequent cases.
I don't think they'd regard this as being disrespectful, just adding clarity IMHO.Posts are not advice and must not be relied upon.0 -
I've left this so late , am 2 days inside my 6 year limit and am madly scrambling to catch up on the last few months of these threads.
Am claiming online ( montego bay to gatwick ,november 2007 ,24 hour delay) . Its just me and my husband, if i do it individually its £60 per claim but together its £80. Im so close to my deadline that i can't afford to get it wrong and have to re submit... can anyone advise me asap. I know its all here somewhere but i can't find it ,sorry.
I don't want to claim for him if it all gets kicked out , but on the other hand we don't want to go to court twice and have two cases if we don't have to0 -

It matters not who the lead passenger was. If you were also a passnger you may bring a legal claim. Ensure that all passengers are named as claimants on the claim form. This means that if using MCOL the claimants box only has space for 2 passengers' names. If there are >2 passengers then use the manual form N1 available from your local county court as this has more space for claimants' names.
You can represent your wife and yourself. All it takes is a signed letter of authority from your wife to state that you can act on her behalf in respect of the claim which you need to send to the court and copy the airline.
Hope this helps

You can put any number of people on one claim and specifically you can put two (adults) on one online claim, to the best of my knowledge.
I assume that you warned Thomson that you would start proceedings (NBA)?
Make sure you claim for interest too.0 -
hi, thank you .
yes i warned them over 14 days ago.
I can't add a name , its already set up with my name on it as 'individual' . I already had an account and clicked 'begin new claim'. It let me add my new address though. It wont let me change or add names.
Shall I just add my husbands name to the particulars?0 -

You can just set up a new account in your joint names however given your 2 day threshold I would be delivering to Court by hand and getting a receipt there and then.0 -
theres no option on the page i am looking at to register jointly. the options are individual or organisation.0

I agree with 111KAB, just fill in http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to the court and get a receipt.Posts are not advice and must not be relied upon.0
