  • Just wanted to say thanks for the information and guidance given on this forum. I was delayed on my flight MAN/MAH in July this year, I wrote to Thomson on my return and received a call this week offering full compensation.

    Received a letter and cheque today from thomson,it said
    Thank you for taking time to speak to us following your flight delay from Cancun
    As a gesture of goodwill i would also like to extend our appologies with a cheque to the value of£100.00 per person in recognition of your loss of time and incovenience.
    Has anybody else received this? Not sure what to do next..when i phoned Thomson to say i was not happy with the amount they paid out, they told us not to expect anymore due to the fact ithat the situation was out of their control,and this was a goodwill gesture.

    I think this has been answered many times before. If they were not liable or bound to compensate under the Reg 261/2004, they would have offered you zilch. Write back one more time making sure its an NBA then issue legal proceedings if they decline to pay you the full amount.

    Yes, we got the same letter and a cheque for £200 (£100 each) and had the exact same thoughts.

    Strangely they made no mention of the previous correspondence or the offer to reimburse our costs whilst waiting at the airport.

    I'll get a reply written at the weekend and return the cheque with a "thanks, but no thanks"...

    just received an offer from Thompson for the full amount of my claim plus court fees which I have accepted
    , another one under the bridge!

    It matters not who the lead passenger was. If you were also a passnger you may bring a legal claim. Ensure that all passengers are named as claimants on the claim form. This means that if using MCOL the claimants box only has space for 2 passengers' names. If there are >2 passengers then use the manual form N1 available from your local county court as this has more space for claimants' names.

    You can represent your wife and yourself. All it takes is a signed letter of authority from your wife to state that you can act on her behalf in respect of the claim which you need to send to the court and copy the airline.
