I too am going through the motions with Thomson relating to delays in 2010. At the time they said that they were awaiting the referred case to the ECJ - which is probably reasonable if frustrating - but like others I have had to chase to finally get the form to fill out.
I also don't have the boarding cards, but do have emails from them at the time when they apologised for delay, etc, which to me is a clear acceptance that we were affected. (I also have my booking ref and correspondence refs from the time). I am also looking in to credit card activity to see if I can establish that way that I was overseas at the relevant time. (For once I am hoping that my wife spent a bomb on duty free on the way back as that would establish date, time and location).
I'm going to be reasonable again and say that the request for boarding cards, etc, may just be to assist with the processing rather than a delaying tactic per se. The easier you can make it for them to confirm your (delayed) travel the easier and quicker they can deal with things.
If they do stall over the boarding cards then (hopefully) we all have an ace up our sleeves - the Data Protection Act. That gives individuals what is known as a Subject Access Right. For the payment of no more than £10, they are required to provide you with copies of all records they hold that relate to you. If they get a mass of such applications they may then re-think their stance.

I am in need of some help. Thomson as expected has stated a hydraulic leak on a previous sector as the reason for the delay and no compensation for the 15 of us is due.
I love the way it takes 3 pages of excuses to say we cannot be compensated!!! What do we do now? Do I go to CAA who seem useless or do we take them to court? If so how will that work as there are 15 of us. I appreciate any help with my next move0 -
Two weeks ago, I wrote to Thomson's claiming compensation for our delayed flight of over 4 hours, from Gran Canaria in February, 2012. I enclosed all details of the booking, flight details etc.
At the time, there was no explanation given as to the reason for the delay. I have now received a reply from Thomson's telling me they regret the delay but they are unable to pay compensation as the reason for the delay was beyond their control. They say that the delay was 'due to a previous scheduled flight having to divert due to poor weather conditions' and 'as the root cause was due to weather conditions. this is classed as an extraordinary circumstance as this is something that is out of our control'. Later in their letter they say that 'the delay was the result of delays to other aircraft caused by the closure of the airport due to extreme weather conditions' and 'the decision to close the airport due to weather conditions is entirely out of our control'.
We were at the airport 3 hours before the scheduled flight time. The airport was operating normally, and there was no evidence that it had been closed that day. The weather was beautiful and had been so for the entire holiday. According to the notice boards, other flights with other airlines were leaving on time to fly to the UK.
Is there any way we can ascertain the reason for the delay, other than from Thomson's, as their explanation does not match up with our recollection of the day?
As this was the fourth time of flying with Thomson and all four times were delayed, we feel enough is enough and they should be made to think about their passengers more sincerely.
I would be most grateful for any advice.
Just to add - the weather in Manchester was fine when we finally arrived there, and had been so for at least a week prior to the flight date. There was no news or evidence to show that Manchester airport had been closed. Is there any way I can check Thomson's 'extraordinary circumstances' excuse about being affected by a previously scheduled flight having been diverted due to bad weather and 'delays to other aircraft being delayed caused by closure of the airport, due to extreme weather conditions'?0 -
Afternoon all, Only just joined the site and looking for a bit of advise regarding a flight myself and my family were due on back in 2010 flight no tom 2545 from Mahon to Manchester we were due to depart at 22.00hr but were told at the check in line that the pilot had been taken ill and a replacement was not possible until the next day we were all transferred to a hotel in Menorca till the following day.I have checked flight stats and its saying the status is unknown. I,m wondering what do i do next do i have a case for flight compensation i still have all our flight cards ect would appreciate any help many thanks Eifion0

Just straight down the court threat, I have no issue with this as I've been to small claims court before? They've given me no reason for the delay at all though, just a standard reply it appears.
Also, can someone confirm, we were told 12 hours before our flight when we were in the hotel that the flight was delayed and hence didn't pick us up until 6 hours after our original pickup time. I presume none of this matters as ultimately it's down to the fact we arrived in the UK 7 hours later than we were meant to?
Also as the flight was July 2008 I need to progress this pretty quick0 -

All correct and only small proviso is to issue 'threat' ie NBA 14 days before you lodge small claims application. Good luck0 -
