Just finished my court bundle ready to send to Thomson and the court. Hugely satisfying feeling, that can only be bettered by depositing their cheque should I win.
Huge thanks to Vauban, ftd83 and legal magpie for your help.
The bundles are due to be served by Friday. How late in the week do you reckon I will have to wait for their bundle?

Hi all,
I have had success claiming from Virgin Atlantic but am really struggling to even get a decent response from THOMSON
They have told me that they are unable to tell me what the reason is for a 7 hour delay other than it was extraordinary circumstances and quoting regulation 261/2004 and saying that it is likened to a car failing an MOT despite a full service history.
I think I am being fobbed off - I have written four times now and the latest letter says "As stated in my previous letter a decision has been made on your claim and I am unable to add anything further. I have now closed your case." They have advised me to refer my claim to the CAA. I am quite happy to chase this myself instead of going to the CAA.
Does anyone else have a similar experience that they have encountered with Thomson or can anyone offer advice?

Centipede: what an extraordinary allegation to suggest that the airlines are simply and unthinkingly copying and pasting their responses, rather than carefully considering each application for compensation on its merits and in accordance with the law.
Why, such an approach would not only be contemptuous of the airlines' own customers but would indeed be a breach of the Regulation necessitating robust enforcement from the CAA. The only motive for such a modus operandi would be if the airlines were attempting to wriggle out of their legal responsibilities by effectively misleading passengers about their statutory rights to compensation.
This is obviously an absurd proposition. No self-respecting business would stoop to such low and ultimately self-defeating tactics.
So it must be an honest misunderstanding. Again.

I have just prepared my complaint/request for compensation letter. My family (all 15 of us) were due to fly at 09:15 am from Gatwick Airport to Sanford Orlando in March 2012 and experienced a delay of 5 hours and 56 minutes. We booked with First Choice but had a Thomson flight.
The delay was advised to some passengers via text messaging though we were not privy to this for no given reason. We were given £3 each for food (which is laughable in itself!) and after a long hunt for a rep were advised that there had been a technical problem on a flight coming in the previous evening from Mexico which caused our delay.
Now I am clearly no expert but this claim is very high in value for our party (I am doing this for all of us) due to the distance of the flight and the length of the delay being over 5 hours. Can Thomson use the technical fault for the other flight being a good enough reason not to compensate?0 -

New to the forums but thought I'd give it a whirl! I sent my letter to Thomson for a 5h 43m delay from Florida to Manchester back on 7 jan 2011 and they said sorry no could do! There was no reason for the delay, no adverse weather or technical issues. Our plane was coming from somewhere else! I've sent it to CAA who have contacted me to say they have sent it back to Thomson for review. What do u think my chances are? Will I have to take it further in your experiences?
