Flight delay and cancellation compensation, Tui/Thomson ONLY

  • Hi, we were delayed for approx 16 hours on the above date, initially told that this was due to bad weather delaying the flight on its journey into Tenerife, therefore exceeding the flying hours for the crew. We were put in accommodation overnight and given a morning flight time. This was then further delayed because of a dispute between the flight crew and Thomson regards how Thomson would give the crew they're hours back. Have looked on flight stats web sight but no info is available re the flight number. Can anyone advise my next steps please ? Pete

    Staff hours is not an EC so you have a case. Not sure why Flightstats has no info? Are you looking at the right date, it might be on the day it was meant to go, or did it get a new flight number? There are more than one way to search on Flightstats.

  • On flight stats, it says status changed from 'scheduled' to 'unknown' not sure how I'd find out if the flight number changed... Just called Thomson, they said to just submit the details on their online form... Yeh right lol.... Are they obliged to give me the details over the phone?
  • Although I am new to this forum I have read many pages in order to assist my claim. Thomson have stated that the previous flight to mine (using the same aircraft) was delayed due to French industrial action and adverse weather conditions over Spain resulting in a knock on effect to my flight and a delay of over 5 hours.

    However, I remain confused over "a particular aircraft on a particular day" and "EC's must relate only to your particular flight". I would be grateful for any advice as to whether I have a valid claim.

    Is it not that the point of the cases to align denied boarding with delayed boarding, so we could use them by analogy.

    Ahhh the more I read the more confused I become...

    It's a fair question and some of the forum regulars take a different stance over this.
    IMO I would quote Finnair in court, as, although it's clearly a denied boarding case, I would argue that the Reg 261 is encompassing of all 3 factors, ie cancellation, delay, and denied boarding, and that an EC that applies to one would logically also have to apply to the other two. I would also use the terminology 'the spirit of the wording' as has been used in a summing up of one case, - Wallentin I think.

    The proposed overhaul of the regs suggests that the wording around EC's strictly applying to your flight only will be made clearer.
    Lets hope so.

    No, unfortunately none of the early TOM claimants took it to task. I did the Monarch one as that was the airline my delay was with.
  • A couple of points: Just been on Flightstats checking our historic delay & they've got it completely wrong! They have our flight landing in the UK before its even taken off from Goa - they've got the landing time wrong by 24hrs!

    Secondly, having just contacted MCOL by phone they tell me I can't use their service for a group claim (there were 4 of us on the same booking) As they only deal with individuals. I've been advised to use the more expensive CCMCC service. Strange as I've seen others on this forum claim for larger parties.
