If they don't respond then you either a) start court proceedings, b) try to interest a NWNF company, or c) walk away.0 -

I sent three letters to Thomson, including a NBA due to getting absolutely zero response from Thomson which was signed by them on 26th June 2013. Low and behold I receive a letter dated 28th June 2013 with a long essay, mainly of blabber, followed by the well reported response in this thread of 2 years limit and "We, therefore, can't consider claims for flights that were delayed more than two years ago".
No explanation was provided for the delay or any information, except that delays are "almost always not our fault".
So, does this leave me the only option but to issue the MCOL now rather than wait 21 days, or must I respond to their irrelevant quote of the 2 year law letter?

If you have written an NBA and they have not offered satisfaction, you can proceed to court.0 -

If your court cut off date is only around a month away you must issue Court claim now as Thomson will look for every way possible to push beyond the 6 years. Thoroughly check your court application for this very reason.0 -
After several phone calls to Thomson and promises of the delay team phoning me back, I have now received a letter from them that had been sent to the Thomson travel shop telling me they are looking into my delay. I have never included the Thomson shop in any of my correspondance and the guy on the phone has no idea why they have done this as all other letters have come direct to me. I feel my privacy has been invaded. What if I didnt want the staff in the shop to know I was claiming?0

I had the same issue- because I booked my holiday via a travel shop, they have requested I channel my complaint through the shop.
This I find strange as the shop is the booking agent- not the service provider......0 -
I am claiming for a recent delay ( 1st July ) plus another delay back in 2009. Both delays were advised as technical and as such do not fall under the umbrella of extraordinary circumstance. If it comes to the crunch and I go to court, is it feasible to combine both claims in a single action?0

Thanks for the posting these defence documents - they really are pointless.
What's with having to prove you were on the flight?
That's very naughty given if you've followed their requests all your boarding cards and evidence would be with them!
Also, noticed people being pulled up for not taking action against Thomson Airways - also sneaky given a poster on here has claimed that Thomson told him it was TUI at Luton address.0 -
Last November i sent in the template letter to Thomsons, heard nothing so called them to be told needed to fill out forms. Forms never arrived called again on 3rd attempt forms were finally sent by email (all a delay tactic as far as im concerned)
As there was 8 of us on the trip it meant 8 x two page forms for the outbound jouney and the same again for in bound.
Thomson finally acknlowledge receipt of this forms 26th February 2013. Fortunetly i still had by boarding pass and the luggage receipts to prove we were indeed on this trip.
Today i have receieved a letter stating our outbound journey was delayed due to bad weather when actually our plane was only 1 of six planes delayed from Gatwick that day.
The inbound journey they are saying as the plane passed its saftey checks then discovered a fuel problem this too is classed as extrordinary circumstances and no compensation is due.
On both delays i was handed a headed note from thomson staing the reasons for our delay
firstly -technical fault
secondly a part for the plane was needed to be flown in from uk
i also have pictures of men in space looking suits trying to fix our plane on the runway.
I have spoken to thomson and told them if need be i will take this to court.
They have tried all ways to delay this claim now they want to change reasons that are stated on their own delay letters they handed out at the time.
Any advice as to what to do next would be apprecaited0
