Just after a bit of help completing MCOL please as Thomsons havent responded to my LBA. Ive used sterling instead of Euros when calculating the amount I am claiming for ( over £3400 !). I've changed the 400 euros per passenger to £339. Is this right or should I put everything in Euros. Does it matter ?

Firstly many thanks to Centipede for pointing me in the right direction on my previous post 152 on page 8 of this forum.
I was due to go to court next Monday the 1st July (at Bolton County Court) but a mediation appointment by phone was set up last week at which point we settled on £1200 for the 2 of us who travelled on this plane and its now in my bank account so all good in the end, you just need tenacity and perseverance. Their first offer was £350 each which I refused and asked the mediator to point them to my trial bundle witness statement, mediator then asked what's the lowest I would be happy to settle with I said £1200, she went back to Mr Moran who had signed my defence statement and he was the person the mediator was talking to at Thomson's and he agreed on £1200 it was all done in about 40 minutes, less than the 1 hour allocated, I will even get my £110 back from the court for the hearing fee as well as its well before the 7 days to court date.
I calculated it would have been at £1308 on the day of mediation and about £1420 on the 1st of July so I was willing to compromise as I deal in definates not maybe's. When they do settle though you always feel like you should have pushed for a bit more. From their point of view it would have cost them with their legal representation about £1800 (if they had lost - which they would have done), so they saved £600, so a 33% saving (which I asked the mediator to tell him). I had done an exceedingly comprehensive trial pack and 4 copies and felt sure that because of this they wanted a settlement. I also got all the library books out on how to defend yourself in the courts - that helped regarding witness statements and particulars and how you should set everything out in numbered paragraphs and numbered pages etc
Help and advice offered to other passenger on this flight if need be. STAY STRONG !0 -

Just shows these people at Thomsons are just playing games with the public and wasting court resourses, something for anyone whoi actually goes to court to mention. Its frivolous to be blocking these claims in the first place.0 -

We were on the same flight, did you cliam for any compo? and have you heard anything back yet? we claimed on 03/06 and stillnot heard a thing!
Hi, we were also on that flight - I sent my claim in on 2 June, not heard anything back as yet. I'm giving it another 2 weeks and then I will submit an Notice Before Action letter (templates are on here) and then start the MCOL. I intend to take it all the way to court if I have to. Hi All,
I was on Flight TOM144 to Mexico on 10th December 2010. The flight was delayed by 24 hours and 40 minutes. Upon arrival in Cancun Thomson issued all parties with a letter to say sorry and cited the reason for the delay as 'late arrival of the operating aircraft'
I began my claim for €1200 after the EU court ruling in November 2012 - after having made an initial complaint straight after the holiday - and I am still to hear any verdict from Thomson. The claims form was returned to Thomson - with all relevant documentation (including boarding passes!!) in January. After many phone calls, where they fobbed me off with 56 day reply time and then 108 day(!!!) reply time & telling me my claim was with claim handler & finally sending an NBA 3 weeks ago and still hearing nothing, I started court proceedings yesterday.
Will keep you all updated with how I get on. I am hoping they will settle out of court as I have written evidence from Thomson themselves that my delay was not caused by any extraordinary circumstances,also have all relevant documentation and Thomson havn't yet at any point actually said they will not be honoring my claim (they have simply ignored me). Does anyone think this is likely?

Hello - quick update
Just received Thomson's Directions Questionnaire and they have ticked the 'Yes' to mediation box. Interesting - I very nearly didn't tick the box myself so now it looks like I'll be chatting to them via the mediation service.
Would be interested in everyone's thoughts on this, I haven't yet had my court allocated so I also haven't yet filed my statement and paperwork yet - hmm. Was interested to read Bobbydog's update a few posts back, but he seemed to have been very very very prepared - will I need to have all the information ready as if I were going to court?

we seem to be days apart from each other and its strange how they have no set pattern as mine came back as no to mediation even though I ticked the box.Yesterday I went on the court website to find it said transferred and then to day i had a notice of transfer of proceedings in the post.Not sure how long it takes for worcester to allocate a court date cant be too long away now.So I have prepared a preliminary statement

Yes, it does seem so random - I'm happy to talk to them via mediation, I am happy to explain for one last time how they really don't have a leg to stand on and I would happily settle for the compensation and interest/court fees rather than going to the hassle of court. I can't decide whether it is a good or bad thing that they are happy to go to mediation! Good luck with your prep work! PS - who is your named Tomsons person? Mine has very bad handwriting but appears to be Claire Welbourn.0
