I suggest you issue an NBA to Thomson, the CAA can't help you! Thomson will only pay out if you issue court proceedings and in your case this will need to be done before the anniversary of your flight date in August as you will then be out of time.
Thanks - I've printed and signed an NBA to send to Thomson tomorrow for a signature delivery with 21 days notice, which should bring us to 16th July 2013. If I do not hear from them by this date, I will proceed with the MCOL on 17th July 2013, well in time for August.0 -

delayed January 2010 Cardiff to malaga
I was delayed by thomsons for 12 hours when the previous flight failed to take off the day before and was posponed to the following day.
The flight again failed to take off and the plane was parked at Cardiff Airport for the full duration of our flight before it took off with the previous days flight leaving us waiting for a replacement plane for a further 6 hours hence the 12 hour delay.
I have written to thomsons and been advised that ot was due to exceptional circumstances,
the responce was that 'the flight was a reactionary delay due to the aircraft having to divert earlier in the day on a previous scheduled flught as the airport the aircraft was due to arrive at was closed.The root cause of the delay to determain if compensation is due was the result of extreme weather conditions'.
The cause of your delay was was the result of delays to other aircraft caused by the closure of the airport due to extreme weather conditions;,
My question is can i claim in the small claims court as thomson operated the aircraft knowing the previous flights airport was closed.
The airports i was flighing to was not closed due to snow.
The plane was parked at cardiff for the entire length of my flight and took off knowing the arrival destination was closed.
im very annoyed by the responce as it goes onto say that snow and closing of airport is never taken lightly my airport was never closed its just a cut and paste letter very badly written with lots of there interpertations of the e2618/2004 ruling

I have had some close contact with a solicitor fighting numerous of these cases and according to him the 'defences' being put forward by Thomson, sometimes purporting to be prepared by a barrister, are laughable and could have been done better by a primary schoolkid! Knock-on effects are NOT covered by the EU Regulation and it is very specific that any extraordinary circumstances must apply to your specific flight, not other flights. Take it further yourself or appoint solicitors to fight it for you and give them a cut of any compo you are awarded. I have chosen the latter course and am happy to pay for the legal boffins to avoid the pitfalls on my behalf. But plenty of folk are fighting their corner themselves0 -
I am claiming compensation for a delayed flight way back in 2008. The flight was delayed by 10 hours going out from Gatwick to Turkey and it was due to the fact that a window needed to be changed on the plane. I wrote to Thomson in the first instance and they have rejected the claim so have now written to the CAA and am awaiting their response. Does anyone think I have a valid claim?0

I suspect the difference in 425 and 444 is which exchange rates are being used. So essentially they'll settle if they don't have to pay the interest.
Given that they would not offer you this is they thought they had a reasonable chance of defending, I think you can be confident about settling on your terms, not theirs.
Ask them for an apology too - and for an admission that they are paying you your statutory compensation under Regulation 261/04! Damages indeed - such weasels!

He said the court wouldn't be impressed by my rejecting the offer just because I wanted a better exchange rate. I said "...and the interest" and his response was "Oh, we can give you the interest". So that is what we agreed on. It works out to about £15 less than my original full claim, but I'm Ok with that.
Someone earlier said they found Tony Moran to be offhand (or something like that). I found him to be quite pleasant and reasonable.
I think it is important to remember that the person you deal with is just doing a job and is not necessarily a personification of the company that has been stalling you for the last 9 months.0 -
We used that office for our successful out of court claim against Thomsons.
Legal papers can be served at a Head Office. Registered Offices are often only a postal address and not manned full time.
Thomsons said on theirlegal papers everything HAD to be sent to Wigmore House. Also that was the address the court told us to use.
Interesting. In that they used the alternative reasoning in a defence document. Clearly, they are being inconsistent.0 -

Just thought I would have a look over on the MCOL to see if there had been any progress and it says my case has been transferred to Worcester which I believe there has already been a win over in that particular court just waiting on my court date now
