When I first joined this, I read a post saying ppl who were claiming nd it was only a very small claim, would it realy be worth it in the long run, meaning with all the compensation claims obviously no doubt the airline would increase the prices.. Thompsons prices from 2012 to now have actually doubled in price I find this absolutely disgraceful considering they are rejecting 99% of claims total joke I think, at least the could pay some £££££ outs befor the try charge ridiculous amounts to ppl...0

Well, I had no proof of flying with Thomsons, credit card account I used had been closed, no boarding passes. So I asked under FOI for info of my name and bingo a pile of papers have arrived - listing me and my husband as a delayed passengers. What shows they have no idea what they are doing is that yesterday they sent a letter telling me to send £10 for the info, today - the info arrived, no payment made!!!DEBT FREE since 2011

With the amount of lying and underhand tactics the airline is employing I think it's the least of your worries.
Another poster has also remarked that when they went to court, they asked the judge why the defence was accepted even though it was filed after the deadline for filing, the judge replied "so what" so they can't have it both ways.
Thank you for this reassurance mark2spark . To be fair, I feel my case against them is so very clear cut that I can't see any legalese wranglings from them having any effect on a judge. I so hope I get to go to court, but thompsons would be idiots to take it that far. I am fed up with hearing them deny fault both in writing and over the phone. One of their team admitted to me that her 'higher ups' had told them to categorise ALL technical faults as exceptional circumstance. Idiots.0 -

I just wondered if there has been anyone who has gone to court yet arguing the 2 year rule and either won or loss? (I saw Thomsons has settled out of court with someone)
Also just wanted to give a bit my details on my case, as there seems to be a number of people on here struggling to get replies. I emailed my first claim to the thomsoncares@thomson.co.uk email address, and gained a response within 48 hours. I also sent my letter before action to this email, and again received a response straight away. I appealed to the CAA who responded within a week, stating they agreed with my argument and notifying me they'd be taking it up with Thomsons (a letter I hope will be useful for my defense in court). I'm currently processing through MCOL and have just received notification Thomsons will be defending their position. In my case, it seems to have been far more efficient to do everything online, I got from writing my first email to putting in my case to MCOL within 2 weeks.0 -
Hi all, have recently discovered this compensation and wondered if we could claim it.
We went to Florida in October 2007 and our flight back was delayed for 5 hours, we were never told a reason therefore don't know why, we also don't still have our boarding passes.
Does anyone think we'd have a chance or is there anywhere we can find out the reason for the delay

You probably have a good chance but you need to post dates/times and as much information as you can lay your hands on. Read the FAQ's on page one and hurry up as 6 year limit will apply.0 -
Just about to to the NBA letter but do I use the Wigmore Lane, Luton address or the Fleming Way, West Sussex address? I've been given different advice from different people and it doesn't take much to confuse me..

The flight back which was delayed was an evening flight and was scheduled for 4.46pm our flight number was TOM3368, it was on a Thursday 18th OCT 2007.
All i can find is that it was scheduled to land in Birmingham at 6:25am on the 19th OCT but we actually landed at 10:32am on the 19th OCT0 -

Well in my opinion you have enough information to submit a claim to Thomson. Whether they pay or not is another question! You then have to decide if you want to front claim yourself or use a firm to handle the matter ~ good luck.0 -
