I filed 2 letters for compensation on the 31/03/13, one on behalf of my mother in law for delayed flights to Cuba 26/12/12
There was 6 in my party and 3 in my mother in laws party.
My mother in law received a cheque today for £1560 so I now await mine!! (£3048) just a matter of time I hope..!

I need a bit of help with my claim. I booked a package holiday to Lanzarote with First Choice (flights with TUI). When we checked in at Edinburgh airport, we were told that there was a 3 hour delay (original flight time 07:15). After two hours when the gate should have been announced the board said the flight had been cancelled and we were to go and collect our luggage. We were put on a coach to Glasgow airport to get a flight at 14:21. When we got there and checked in again, the new department time was 15:21 (8 hour delay).
My questions are:
1) Should I be completing the Which draft letter? I don't want to take it to the small claims court.
2) Do I follow the delayed flight route or the cancelled flight but I took the re-routing option?
3) I am unsure whether the Canary Islands are outwith the EU and does this matter? Cabin crew said the Canary Islands aren't in the EU (announced for duty free purposes) but can't find anything official that confirms this. Will this make a difference to the amount I propose to claim?
4) Looking at the Which compensation table, it looks like it doesn't matter whether it's the cancellation or the delayed flight table but I think I'm looking at €400. This might sounds like a daft question, but is that per person?
5) Should I be calculating the flight distance from Edinburgh or Glasgow (to work out compensation)? Also I have looked up both on a couple of sites and they were very different. Is there a reliable site I could use?0 -

I'm currently at the NBA stage and a thought occurred to me; has anybody ever tried to make a deal with Thomson?
If you are due £1000 in compensation, what about informing then you would accept £850 (and also save them interest, court costs etc) as a settlement?
I would assume that Thomson are aware they will lose a lot of cases going to court so might fancy saving a few quid?0 -
Thanks for you reply, very helpful. I spoke to our holiday insurers this evening and they said to pursue it with the flight operator but will check again with their claims department tomorrow. TUI gave us a letter of proof of cancellation and re-routing to provide our insurers which makes it sound like they won't pay out themselves.0

Tried this with Monarch a year ago (well almost) - said I couldn't be *rsed to go to court and willing to accept a quick payment into bank account ******** and sort code ****** and never received a reply! Was willing to accept a 20% reduction - now if I 'win' it has cost them at least 6 times the compensation I was and know I am due!0 -
I've given up waiting for the CAA to get back to me so I have just prepared my LBA to Thomsons asking for 3200 Euros or I will issue legal proceedings against them and then make an application for court costs and 8% interest on the 3200 Euros from the 04/06/10. Am I right in saying that like criminal court cases, I could quote all the successfull (fingers crossed) civil court cases that are likely to have been heard by the time my case goes to court. At least then there is a good chance most of Thomsons defences will have been tested and i could refer to these cases when I go to court. I will still continue with MCOL but at some point Thomsons are surely going to have to accept that most of their defences in court are going to fail.0

The European court cases are precedent law - small claims court verdicts are not.0 -
Sent my 14 day NBA to Thomson last Friday after giving them there 56 days to respond, with no response. The 2 year date is actually very close, I wonder if they will wait until then to reply.
