    Notice Before Action - basically their notification that you will proceed to court unless they can persuade you otherwise. Template on the FAQ page

    Did they send correspondence to you when they received your claim form or did they just send the cheque ?

    A little advice needed.

    In 2010 I was delayed by 26hrs returning from Egypt and in 2011 delayed 22hrs returning from Turkey (I know, must be unlucky). For both delays we filed compensation letters and were rejected stating until the law is verified they will not pay out.

    Now it seems the law is verified, is it best to contact Thomson about the 2 instance seperately, or combine the 2 as one claim?

    Both delays were technical problems leading to crew being out of time.

    I have received the standard two year letter from Thomson and have decided to take this matter to the courts. I have legal costs insurance on my home insurance policy and have decided to pursue this matter using that policy.

    I have been informed by the panel solicitors of the Insurance company that although they will write a standard PAC letter to Thomson on my behalf, my insurance will not cover their costs for Court Proceedings. The explanation they have given is ‘Court Proceedings will not be proportionate as legal costs are unlikely to be recoverable and will substantially exceed the sum in dispute’. Has anyone come across this reasoning before and how have you dealt with it?

    My claim from Thomson is for Euros 2,400.

    I have checked my legal costs policy document and can’t find any exclusion for ‘Proportionality’, the only similar exclusion I could find was where the dispute amount is less than £125 plus VAT. Any views?

    If what I am being told is correct, then legal costs policies are not really what they purport to be when the matter has to be taken to court, they will mainly work when the claim amounts are very high or the legal costs can be recovered from the other party, any views?

    Many thanks for your guidance, we have written as suggested to Thomson using the template, this was sent the next day ie 29th Matrch, to which we have recieved no sesronse , is the correct action to take now an NBA letter reiterating the fcats as stated in my claims letter ?

    32 days - Be patient ! They're looking at claims at around 70-80 days old, however I was told that they are increasing staffing to reduce the backlog
    My claims been with them over 100 days now & still waiting for their reply !!
