Any idea what sort of costs are involved with going through small claims court?
I don't really have the time or knowldege to go down this route so might sit tight and see what happens over the next few months. If not might try a no win no fee....

It depends on the value of your claim

My claim was for £4900 and I paid £100 so if I win will definitely be worth it

That's only the initial fee. For a claim of £4900, you would then have to pay £40 to allocate to a claim track, and a further £325 hearing fee, presuming Thomson file a defence

Are you talking about how much it would cost you to take the claim to court, or are you worried about having to pay thomsons costs if you lose??? Under Civil procedure rules, you can not be ordered to pay thomsons legal costs unless the judge thinks you've acted unreasonably, e.g, not giving Thomson any opportunity to sort the issue out prior to Court or failing to accept a reasonable settlement from Thomson.

In terms of the costs that you will incur for proceeding with the case, this is entirely dependant on how much compensation you are claiming. If you tell me how much compensation you are claiming, I can tell you how much it will cost you

I think my overall claim is for roughly £1000

For claims between £1000 and £1500, you would pay £70 to submit the claim (presuming you submit it using MCOL), then there is a hearing fee of £110, both of which would be recoverable from Thomson if you were successful. If you are unsuccessfully, presuming you have acted reasonably throughout the process, any order of costs would be limited. You could be liable to costs incurred by Thomson or its represenatives in attending the hearing, e.g travel/accommodation. You would not normally be ordered to pay Thomsona legal fees

Another issue emerging here, which clearly indicates that Thomson know full well their '2 year' claim is erroneous, is the fact that they cite that first and then 'Extraordinary Circs' second, in case the first fails. If they are convinced of their 2 year claim, the EC's need never come into play? But it seems they are not alone in the fact that most (if not all) airlines are determined to resist these claims. And to the bitter end

Whether you've started the process or not: !!!! the caa - a toothless organisation if there ever was one.

DO NOT USE THEM! If you did, shame-wasted time

First complaint letter, then nba letter, then court.

Don't take the !!!! thomson give you - milk them for whatever you can get
