    flight TCX 2358 on 09/06/2012 from ManchesterAirport to KOS

    Theyve not given me a reason!!:p

    I have emailed the woman back, politely asking for cheque/cash on this occasion..

  • Hi , my family and I were delayed for over 6 hours on a Thomas cook flight to Sanford from Manchester on 23/09/2010 I have sent the standard template letter and got several replies saying they are looking into this matter but the problem I've got is I have no booking reference number , tickets or emails with any evidence of the flight the only thing I have is my bank statement with proof of payment and my passport stamped on the date in Sanford . Has anyone got anywhere without the relevant documents ?

    That should be enough it is up to them to prove you were not on the flight was it tcx 44

    I contacted TC about a flight back in 2007 which I did complain at the time and got no where. I was delayed 13 hours.

    They have replied saying "Initially, I would like to apologise for the delay. Unfortunately, our investigations have been hindered due to your flight being taken on an airline that no longer exists. The flight in question was operated by My Travel, and whilst this
    company merged with Thomas Cook some years ago, at the time it was operated independently of the Thomas Cook group.

    Despite extensive investigations we have been unable to locate the flight logs of the aircraft concerned, which would allow us to ascertain the reason for the delay. In order to comply with the requirements of Regulation 261 the airline have to establish the cause of the delay, to see if compensation is applicable. Without these important documents, the delay in you submitting your claim has prevented us from being able to adequately investigate this case.

    This is regrettably one of the drawbacks of submitting claims so long after a flight departure. We do indicate in our terms and conditions that it is difficult and sometimes impossible to properly investigate a complaint if we are not told about it reasonably quickly once the holiday is over. Your right to compensation may also be reduced or extinguished, should any delay in your complaint being notified during or after your Holiday, prevent us carrying out a proper investigation.


    In view of the above, we are unable to assess your claim for compensation on this occasion and regret to advise that we cannot give consideration to your request. "

    er you buy an airline with liabilities and don't keep the records!

    Not the passengers problem is it.

    The CAA may want to know why they haven't got the records.

    They possibly haven't got the aircraft either!
    The other question is, how long are they required to keep the records?

    They know people have six years to make a claim, would appear to be a tadge careless throwing them out before the expiry of that legal time frame. The airline does not to have to establish the cause of the delay to comply with 261. It does however have to come up with some excuse if it wishes to deny your claim on the grounds of extraordinary circumstances. If they cannot find a reason for the delay, they cannot claim ec so you are just about sorted 600 Euros per person

    My solicitor has just informed me that even though she thinks we would win in court, the decision would be unenforceable if they decided not to pay up as Thomas Cook run at a loss and therefore have no assets apparently?
