Flight delay and cancellation compensation, Thomas Cook ONLY

  • I was recently due to return from Kos airport to Manchester and we had our flight cancelled twice. Original flight was due to leave at 1800 GMT on 5 Jun and the actual departure time was 0517 on 7 Jun. We were sent away from the airport and put to a hotel on the first day and then returned to the airport the next day and then for a second time sent to another hotel before being returned early the next morning to the airport again for our flight. I understand from the website that we are entitled to €400 per person compensation which Thomas Cook have already offered but I wondered if there was anything else I could claim due to the fact that we were sent away from the airport twice and the upset and disruption this has caused? Or even if I can claim for a cancelled flight on top of the claim for the delay. We were sent away from teh airport twice so two flights were cancelled but through all of this they kept the flight number the same so I am guessing this is just classed as one flight cancelation? The flight was DE1725 Kos to Manchester.
    Any help would be appreciated...Thanks!

    It is one EU261 claim which it seems TC are not shirking. Have you checked your travel insurance to see what it covers in the case of delays?

    Depending on all the circumstances you may be able to claim additional compensation on the basis of breach of contract but this is a separate head of claim to the EU261 claim. Given that they have accepted your EU261 claim, this could be difficult but certainly not impossible. In my own case Thomson rejected my EU261 claim so I added a claim for additional compensation and got it (albeit as a settlement at Court)

    Me again-just a quick message to let anyone who has been following my case against TC that i have finally heard from the judge and she ruled in my favour!!
    I am chuffed! I cannot begin to thank all on here for the completely invaluable advice they've given. I am truly grateful!
    Awarded €1200 plus costs! As always though I have more questions!
    In my submission I'd asked for interest on that compensation but there was nothing mentioned in her judgement. Can I still ask for it? Also requested recompense for attending the court that day etc. Should I put in a further letter requesting those?
    Again I cannot thank you all for your advice. I truly believe I would have just given up once it was at court stage but with all how the step by step guides I was given and the expert advice I had, I had confidence not to give up. So anyone who is thinking of just giving
    Up and letting them win-DONT! Just go for it and show the big companies that they don't make the rules!
    A definite drink to celebrate tonight I think!

    endaf - firstly congratulations. Even though you requested interest and costs it appears the judge either overlooked or discarded. What are the costs you were awarded over and above your claim and what exchange rate (if any) is mentioned in the award?
    There is no harm in your raising the request for interest and court attendance costs however I believe you have the award and that is it but if you request I would submit asap.

    Thanks for the cangrats!
    Costs were £165 but I need to check if that covers it all as back of
    My mind I think I paid out more than that as did an online case first before it went "clerical" but will obviously check.
    No mention at all of interest or exchange rate. What rate should TC use?
    I think I'll send a courteous letter to the courts-no harm in trying but to be honest even if she awarded £1 to me I would have been happy as I beat them!! I bloody won!!
    But obviously lets gets them for every penny I can!

    Well done. Great result. It will certainly do no harm to write to the Court concerning interest given that the Judge has given a written judgment and may have overlooked it. The sooner the better

    So happy for you, have now emailed TC to see what they have to say, ccc you in the email hope that was OK and I bcc other passengers in on it. I've been sat back waiting to see how it went for you, if I get no joy with them I will go take other action :):T:T:T

    Hi
    My partner and I were delayed on our return flight from Antalya to Gatwick on MT1655 on 5th April. I have filled in our details on the resolver tool and as yet have heard nothing back from T Cook. I filed this on 6th April and understand that in 4 days I can escalate this to the CAA. Having previously written to the airlines directly in other successful claims should I have done this in this instance or have others had success through the resolver tool? I guess it's either a case of sit and wait or be proactive... What do you suggest?
