  • So after launching my claim on line and getting back a defence but offer to settle on a no admission basis. TC promised to pay up - 3 weeks ago. Still not paid (why am I not surprised?) and so since deadline to allocate to court is due I have no option but to move to next stage.


    This time I am not just looking for Regulation compensation. Now am I looking for interest, postage, time wasting costs ( I am very expensive) and a nice public judgment which others could use to their benefit.
    Either they are very underhand or absolutely incompetent! :mad:

    You are quite right. You have been put to the trouble of having to issue Court proceedings so you must press on with them until you receive the full amount you are owed. But you won't get postage or compensation for loss of time unless you have to attend a Court hearing which seems unlikely. If you do get a cheque from them make sure that it includes your court fee, interest (if you claimed it) and also check on the exchange rate which should be calculated as at the date of payment.

  • I have been offered vouchers by Thomas Cook for my flight delay compensation. I have emailed back and asked for cash. Am I within my rights to do this and can they refuse? Its just they have not replied back and we heard that they might offer less because it is cash?

    as per Vauban's guide you are entitled to cash. Whether it will be less than the voucher value will depend on what they offered in vouchers. The actual compensation is a fixed amount based on distance although some airlines will offer a higher amount in vouchers...in which case you would not be entitled to the same value in cash
    eg €250 compensation due, €300 voucher offered...requesting cash would get you €250
  • This is an update to my original post in 2013. Originally rejected and given the expected run around regarding the claim I approached Bott and Co, who didn't wish to accept the case. Anyway I submitted a couple more complaints, 1 through Resolver and the other direct on their website following Huzar. Received an email from TC today to say they are paying me 800 Euros compensation. Success without the need to go to court. Very happy.

    Hi all, just a quick update for any (if any!) that are following my case with TC, the court case has now been moved forward to the 5th of May after TC asked for an extension. not sure if theyre request is a good thing or not really! but with the case now in May, it'll be just shy of 2 years since the 16hr delay to our holiday! but still as determined as ever!

    Just found this as I was searching through previous posts for clues & anything useful...

    As I have posted previously, we were on TCX7523 from Antalya to Stansted on 14th August 2015 which was delayed by 4hrs 55 minutes. Once on-board the flight, the head cabin crew told us that the reason for the delay was....... yep, an arming handle that had been broken by a passenger on an earlier rotation of the aircraft. However, we were told that it was broken whilst boarding in Lanzarote around lunchtime the day before - we checked & the only TC flight out of Lanzarote that was delayed was TCX7125, scheduled to arrive at Stansted 16:07, actual arrival 19:43.

    2 different flights affected by what would appear to be a pretty rare accidental damage incident on the same day. Coincidence or cover-up?

    Would be interesting to see, if this is genuine, how many arming handles have been broken by passengers. This could potentially shoot down TC's claim of 'extraordinary circumstance'.

    As both these were knock-on's, should be just a matter of waiting for the courts to issue a date then sit back & wait for the compensation to come out. All opinions & comments welcome.

    April 2016 - successfully claimed €1600 from Thomas Cook for 6 hour delay in August 2015
    Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.

    Hi,

    Don't give up on this - we had the same excuse - broken arming handle - on our flight (TCX7523, Antalya to Stansted on 14/08/2015).

    I've put a few posts up about it - search our flight number if you want to read them.

    We were told the handle had been broken on an earlier flight whilst boarding in Lanzarote & found the actual flight number the damage occurred on was TCX7125, 13th August. Now either 2 different flights had the same issue within hours of each other (which may indicate that this issue isn't an extra-ordinary circumstance after all), or TC are fabricating the cause. Either way we have been advised that if your delay is a knock-on (ie caused by a problem on an earlier flight), then unless the cause is bad weather, it can't be used as an excuse. We have passed our details to Bott & Co who advise we have a good case. If you don't feel confident in fighting TC yourself, use a no win - no fee solicitor to take them on for you. Good luck.

    Hi all

    To update you on the above, I ended up writing to the airline's head of legal at her business address (not the registered address of the company). I sent a copy of the letter to the customer relations email address.

    It worked fine - Thomas Cook paid me within about a week of receiving my letter.
