Hi, yeah ive read Vauban's guide (which is very informative & would highly recommend to anyone) although i couldnt see any info on the actual court hearing itself & how it worked. so basically i just need to highlight the main aspects of my case again to the judge, quoting the relevant court cases then?
the case has been allocated a 2 hour slot-just concerned what we'll talk about for 2 hours! so obviously want to be as prepared as possible. It can be handy to have a friend present. (although they cannot speak) If either of you pick up on something that is wrong, inaccurate or you wish to question then make a written note of it. The judge can pick up and correct if he/she feels either party is going off track is is blatantly abusing the process.
Read Vauban's guide I think it has his court scenario written up. But basically, you will talk through a precis of your case adding any detail or highlighting anything in your written you think is pertinent. Defendent will do the same. Both will get a chance to question each other. Then sum up. then decision.0 -
If you read through the Court failures thread _ its a LONG way back in the list of threads, you may get an idea. Vauban's experience in the Monarch thread is well documented too.If you're new. read The FAQ and Vauban's Guide

Prior to hearing prepare your skeleton argument (1 or 2 page) with salient information. 3 copies required, judge, defendant and yourself. Hand to Clerk of the Court so as to be given to the Judge prior to your entering court room. 2 hour slot allocated but rarely takes that long and this time usually includes the 10 minutes the judge takes to familiarise him/her self with the case (ie time to read your skeleton submission) and the 20 mins or so taken for the summary to be transposed.0

Hi can anyone help please?. I just spent New Year in Dalaman. I booked a Thomas Cook flight from Manchester to Dalaman to fly out on 29.12.15, and separately booked a flight from Dalaman to Manchester on to get me back home on 9.2.16.
The DLM to MCR flight home was booked on 25/9/15 but three weeks later I got an email from Thomas Cook to say this flight would not now be operating for 'economic reasons'. It was cancelled and there were no alternative flights from DLM to MCR fo the return leg of my journey.
Would I be entitled to any compensation for this cancellation? Whilst I did get a refund, I ended up having to book a flight home to MCR from Antalya airport, which is a 6 hour drive from DLM, which entailed a costly taxi fare for me.0 -
No - you are not entitled to compensation if the change is made outside of 14 days before the flight. You had nearly five months to make alternative arrangements, and to be fair if you buy a return flight as two singles always carry a risk that one of them can go a bit awry.0

Hello. Does anyone know who I should write to when sending a letter before action to Thomas Cook?
The only address I have for them is their Customer Relations' address: PO Box 216, Bradford, BD19 9BN.
I see that their company house registered address is: The Thomas Cook Business Park, Coningsby Road, Peterborough, PE3 8SB.
Shall I write to their business address? And who should I address my letter to?0 -

Vauban's extremely useful and comprehensive guide says Head Office. I would hold off doing anything until you have read the guide (linked very frequently on various threads).0 -
Thanks for the reply. I have actually read that guide, and I appreciate the point is dealt with in that guide.
However, it is difficult to actually say where Thomas Cooks' head office actually is.
Thomas Cook Group PLC's registered address is: 3rd Floor, South Building 200 Aldersgate, London, EC1A 4HD
Thomas Cook Airlines Limited's registered address is: The Thomas Cook Business Park, Peterborough, PE3 8SB.
The so-called 'compensation forms' that I have completed give an entirely different address altogether (the PO box in my previous letter).
I was wondering whether anyone has had any success in writing to either of the addresses above.
I am currently thinking the best line of attack is to address it to Thomas Cook Airlines Limited and mark it for the attention of 'The Legal Department' (I appreciate the guide says to address it to the chairman but in reality the legal department (or even the customer services department) will deal with this letter before action.
If anyone can tell me the address that they went for (and whether they had any success), that would be much appreciated.0 -

I would go for the company's Registered Office so for the airline, Peterborough. The point about writing to the Chairman/woman is not because he/she will deal with it personally, or indeed even read it, but rather it tends to get matters higher up the agenda of the people who will deal with it. I'm not sure what the legal position is but if you address to the Chair, that is (a) a named individual and (b) someone with apparent authority. It may be that sending to the "legal department" satisfies the legal requirement of the NBA but why risk it?
You'd need to read this thread to establish how TC have responded to others. From reading the board, there is no discernible pattern and the best thing is to take action yourself if you believe you have a case.0
