Hi all,
I'm looking for some guidance to help me decide whether to pursue T.C. myself or to go down the NWNF route.
It all depends on the circumstances & whether I can prove that T.C. could have taken more appropriate action following our delayed flight.
Brief details;
TCX7523 - Antalya, Turkey to Stansted, 14/08/2015.
Scheduled departure 01:15, actual 06:42 (local time).
Scheduled arrival 03:45, actual arrival 08:40.
A delay of 4 hours 55 minutes, overnight, in Antalya airport with 2 children.
Check-in information advised a delay of 2 hours, T.C. staff unable to offer any information.
Only refreshments offered were a burger or slice of pizza & a can of fizzy drink at around 02:00. No T.C. representation once through security.
Once on the aircraft, cabin crew explained that the delay occurred due to an emergency door arming mechanism being broken by a passenger during boarding on an earlier rotation to Lanzarote (same aircraft - flight TCX7125). This resulted in 55 passengers needing to be off-loaded (volunteers were requested & offered eu400 pp).
We have calculated that the damage occurred at approximately 12:15 (local) - 20 minutes prior to the scheduled departure time of
I believe this would have been 11:15 local in Antalya.
TCX7125 then arrived back to Stansted 3 hours & 12 minutes behind schedule at 19:47 (BST), 21:47 local to Antalya - approx 2 hours before our check-in.
The next rotation was TCX7522, Stansted to Antalya. Whilst checking live data in Antalya on mobile devices at the time we could see that this flight was delayed by around 4 hours, but information being provided was inconsistent.
Anyway, back to the main reason for the post - 1. Can a piece of safety equipment that has been broken by a passenger be classed as "extra-ordinary circumstances"? & 2. Could T.C. have done more to avoid the delay to TCX7523?

Hi Steve,
I believe you have a good reason to claim compensation from TC.
The incident with the door did not directly affect your flight, it was a 'knock on' from two flights earlier. Therefore it could not be an EC.
There have been cases where something similar has happened and the judge has found in the passengers favour.
TC had loads of time to make alternative arrangements for your flight back to the UK but chose the easy way out for them, not the passenger.
You could go down the DIY route by following the advice in Vaubans great guide or put your details into a couple of NWNF solicitors web site and hand it over to them.

Received offer of full compensation yesterday. Shame it took to issue proceedings first wasting my time and court time.
Would advise use of resolver in first instance, useful templates and process, then v simple issue of court proceedings, again used wording from resolver. Read Vauban, all you need to know is there and issue money claims on line. Cost £100.
Ignore offers of vouchers, discount offers etc.

TCX6523 Dalaman to Newcastle 31/08/2015 Hi, i am just looking for a bit help, i have submitted a claim for compensation for a delayed flight from Dalaman to Newcastle (delayed 17 hours), Thomas Cook are refusing to pay out because the outbound flight from Newcastle to Dalaman had to be diverted to Bulgaria because of a unruly passenger, the passenger was ejected & flew from bulgaria to dalaman without any further problems, Thomas cook are claiming this is a 'extraordinary circumstance' & i have also contacted bott & co who are not prepared to take my case forward on a no win no fee basis, so at the moment i dont know what to do, have i got a case i have read various rulings & they say Thomas Cook cannot use this as a knock on effect, if i was on the original flight with the unruly passenger i would understand but there was a flight in between ours which had no problems it was only the flight home from Dalaman to newcastle that the staff were unable to operate, I would be grateful for any advice, i have tried dealing with Thomas Cook & used the templates through revolver, i got nowhere so passed it on to bott & co who informed me they have gone as far as they can no win no fee.thanks Dave.0

Massive thanks to MSE, heard about this last week, put the claim in on Friday via the Thomas Cook website for a 7 hour delay in August 2010 for a family of 4. Just had a reply to say they have accepted my claim and a payment will be in my account for £1,940.00 (equivalent of 600 euros each) within 10 working days. The only confirmation I sent them was a screenshot from the Flightstats website and they accepted my claim, no questions. Now that's service!! Thanks again MSE. :T :beer:0
