Flight delay and cancellation compensation, Thomas Cook ONLY

No it wasn't my flight. It was the flight out to Hurghada, whereas we were flying home from Hurghada. TC say they can use knock on delay as a defence for up to 2 flights prior to mine involving the aircraft.
My parents, who were flying home the same day from Hurghada to Gatwick and a couple who were on our flight but got a private taxi to the airport all say the check in board showed our flight as cancelled, yet TC say it was just delayed. I'm not sure if that makes a difference or how to check. We never left the hotel as were stopped when the coach arrived to take us to the airport.0 -
Interesting about the knock on - no idea if that's true or not as the bird strike to my flight took place days before and I'd got info from the CAA saying that the plane had been flying those days ! I've not come across the 2 flights defence in anything I've seen when researching my claim. I did still point out to Thomsons that it wasn't my flight that had suffered bird strike, therefore they'd basically put us on a damaged plane and so the extraordinary circumstances did not apply. But then given we were delayed for 3 separate reasons, I don't really know what made them decide not to defend and settle !0

Hi all supplied TC with booking invoice/holiday itinerary to prove we were all on the flights concerned and to my shock I got the response that we cant claim as our flight was only delayed for 5 minutes not 6 hours. even though we were taken back to the hotel which was over an hour away, given food and drink then shipped back to the airport.
Or are we unable to claim because we hadnt checked in when we were informed there was a problem with our flight and we were being taken back to the hotel until the plane was repaired and flown back out to pick us up
SHOCK NEWS
Emailed TC back asking for proof that we were only delayed by 5 mins and if I didn't receive proof I would be taking the matter to court and this morning I've received an email with an attachment for gift vouchers worth £2565. now im going to email them back as I've asked for them in cash.
But my question is should I receive the €400 at the exchange rate at the time of flying or todays exchange rate the difference in £ is about 800?0 -
I wanted to claim for a 6 hour delay from 2006. TC have said that I can only go back 6 years, and they don't have any details on flights more than 6 years ago. I don't have the flight number and can't find it on flightstats. Any suggestions?0

Even if you had the flight number, boarding passes etc and the delay was valid for compensation, TC can easily reject your claim (or ignore you) as they know that after the 6 years there is absolutely nothing you can do about it as you have not commenced court proceedings within 6 years of the flight date0 -
FLIGHT NO MT73 HOLGUIN TO MANCHESTER 8th SEP 2010...
Just wondering has anyone made a claim against Thomas Cook for this flight delayed over 5hrs in cuba just starting my claim have also noted its 5yrs in scotland but as this was a english airport does that come under the six year ruling any help welcomed....0 -
When I received the email saying TC accept my claim they made a full and final offer of £2560 in travel vouchers,
I emailed them back to say as I'm representing 9 people I want it as cash not vouchers also we arnt planning on going away next year.
Now I told they will only offer me the vouchers nothing else. I've asked all along for cash not vouchers
What do I do now?0 -

First, get TC to put this is writing (if you don't have it in writing).
Then (and this isn't something I often advise!) write to the CAA enclosing this correspondence. Ask the CAA what they are going to do about this flagrant breach of the Regulation.
(You're very unlucky - most people just get the money when they ask for it, once vouchers are offered.)0 -
I've passed over my case to Bott & Co as it's been stressing me too much. I'm pleased that they have confirmed I do have a case and they will fight it for me. Not sure how long it will take but at least the pressure is off my shoulders.0
