It's worth noting in the Huzar case due to be listed at the Court of Appeal on the 22nd or 23rd of May 2014 that the issues surrounding that particular flight were heard by 3 separate District Judges in 3 separate courts ran by 3 different litigants in person and each DJ found that the flight was not claimable; and yet His Honour Judge Platts found differently and gave judgment for Mr Huzar.
I'm afraid there are countless, countless instances of this. Success for others on the same flight, and indeed defeat in the case of Huzar, guarantees nothing.0 -

But I can categorically state, that a successful claim by a person on the same flight, does not automatically lead to a successful claim for you.0 -

In regards to not paying out if on the same plane, I can't argue if people are brining up incidents which back up that. I worked on the logic that I was in a car accident in a taxi, waited 11 months to claim, and then found out the driver already had and was near the end of the process. His solicitor ended up representing me and said they had agreed to pay the driver so it was a foregone conclusion I would get a pay out too - which I did - and it cut down my waiting time to only a couple of months.
I don't know what your view is on riding a others coat tail as you highlighted, though it suggests you don't approve of it. All I know is if it was me, and something that was settled in my favour DID help someone else in the same situation, why on earth would I begrudge them? Sure I did a lot of work, and now they might have it easier, but why hold bitterness to a fellow human being in the same situation? So my view on it, is it's not a bad thing at all.
Now I know that the case is taken on its individual merits fair enough. But I don't think there is any harm networking with an individual going through the same process as me on the same flight. I don't think I'm being unreasonable at all in my statements I genuinely feel I am defending myself here justly.
I have read the FAQ. Remember not everyone is tech savy, and although it may seem extemely easy to look things up on a forum to some, I know countless people struggle more than to post a question and look for a reply. Initially I asked about contact with a certain individual on here. I searched the forum for their posts and anything related to my flight.
Like I said this is a place where people look for help. Not for negativity. I appreciate people may have answered the same questions in the past, but you don't need to feel frustrated about repeating yourself if you don't say anything at all. If it upsets you to answer a question again for someone new, maybe it's better to leave it to someone who doesn't mind. That goes to the main contributors here which seemed to take offence to what I said in their replies.
At the end of the day new people will come here everyday and ask the same questions. Point people in the right direction politely, or don't say anything at all if it upsets you to do this. I don't think that's an unreasonable request at all. I appreciate the advice and I will take it on board.
Vauban is a well learned forum member and without his help many on here would have give up a long time ago. You cannot rely on using the analogy of if one get paid out then I should, the whole thread is about the real world when it comes down to airlines and judges. If this was a normal situation and airlines were to abide by the regulations then there would be no need for this thread. I would suggest you take on board what the forum members are saying as they can give you a whole heap of help if needed. Many posters ask the same questions that can be answered on page one and should use the search box at the top, but many do not, this can be frustrating when information needs to be repeated again, and again. I started the same way but I scanned through for my answers and learned along the way. Claiming is not as easy as the TV programme suggests and needs a lot of work and effort, if you do not want to go that root the a NWNF company is best for you. Vauban is a valued member of this forum and he has earned his spurs the hard way.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Thank you JPears for stepping in yet again with some sound advice on this forum.
Perhaps we need a 'sticky' to remind ourselves of some of the guiding principles of the forum:
'Sadly new posters seem to be treated harshly more often than they used to be. Often it's because they ask questions that have been asked, or post in the wrong place.'
'There is also sometimes a 'this is our board' attitude which seems not to want new posters coming in and ruining an established clique'
'To be utterly clear-this goes against the philosophy of the site'
'New forum users have a 'newbie image' under their username. We hope it helps the more regular users to be more tolerant of new users who may ask questions of them.'
We have seen some unpleasant spats on this forum in the recent past and we all have a duty to ensure there are none in the future.0 -

It's a shame that folk didn't take JP's invitation to draw a line under this spat, which is unseemly and merely distracts from the purpose of the forum.
Listen investalways: If you think that my response was unacceptable and breaches the rules of this forum, you should report it to the Admin team. But I'm still not sure what you consider was rude in it. Perhaps my characterisation of your strategem of waiting for others to take court action as "riding on their coat tails"? Or something else? To be honest, your posts - where have called me an "a$$hole", and accused others of bullying you - are infinitely more offensive and aggressive, IMHO.
But lets try to bring this back on topic. Despite what you might think, you have had some good advice (including even from me!) on why your approach is unlikely to work: so what are you going to do next to progress your claim?0 -
It might be a case of not liking being told that they were wrong.
Making a comparison of a taxi accident and Regulation EU261 as a justification I mean.
I've re-read stuff and just think that honest opinions of the case in hand have been given.
I suppose it's pack mentality if everyone tells you that you're wrong and you know that your not lol

Had a reply from Thomas Cook confirming I would receive £424.00 compensation from a flight from Menorca to Stansted which not only was delayed over three hours but diverted to Gatwick so a bus service was arranged, eventually meaning our arrival time back to destination was ten hours. the £424 was for £212 each but we had our children also (only one had their own seat though
Should I decline amount or do children not come under the new regulations? Not expecting anything for child on lap but would a child fare be covered?0
