    EPF's are a technical problem and as such technical problems are commonplace with aircraft and by no means extraordinary. If your plane was delayed over 3 hours you are entitled to compensation.

    Thanks for your advice.I am going to try a Freedom of Information request to try and get the information from the CAA.They are a public body and are on the list of organisations that should respond.If I am successful I will let you know.If this fails then it looks like the small claims court.

    I don't understand why you would do that? A freedom of information request against the CAA will get you no further with getting your compensation! The CAA say you have a valid claim and that's enough for you to proceed straight to court with TC if they won't take any notice of them. I would say they would fold just before you were due in court.

    Good luck - but I fear you won't get a lot, even with an FOI request. When I put one in to the CAA they refused using the exemption afforded by their enforcement responsibilities under the UK Enterprise Act. Let us know how it goes.

    Yeah, I have been watching from afar, nothing to report at my end until the huzar case anyway, I took your advice and did a FOA regarding the aircraft. But got the same response as above in that the CAA refused. It's about time they were looked into, how can they be called an authority when they have none!!!!!
  • I'm hoping someone here will be able to help me - we had a delay with Thomas Cook last year so wrote for compensation. Amazingly, they gave it to us with no quibbles whatsoever, but it was in Thomas Cook vouchers. My question is, can we ask for cash as compensation rather than vouchers and do they have to give it, or can they palm us off with vouchers? It's not a huge issue, but we are waiting on another claim with Thomas Cook from the previous year (the flight was horrendously delayed, then diverted to Gatwick as a windscreen wiper wasn't working - we were meant to be flying to Manchester but it was raining there - and they're now saying we weren't delayed as it was two separate flights, despite the fact that it was them who made it two separate flights - doh!) and I'm not terribly keen on using them again in the future, so would prefer cash, if we do get anywhere with the second claim.
