Flight delay and cancellation compensation, Thomas Cook ONLY

  • If your flight was departing from Spanish jurisdiction the CAA will not comment on the flight.
  • That's what I thought Socrates. I believe Thomas Cook have used this as a tactical move. My question is - what move should I make next?

    YAY Bott and Co have come through for me just had email T.Cook have settled now to wait 42 days for money from them hahaha.:j

    what move should I make next?

    The usual response is to say:
    1. Read the FAQ's on page 1 of this thread.
    2. Read through the other posts on this thread (I know, there are a lot).
    Then assuming you are confident your delay counts for compensation and want to deal with it yourself:
    3. Send TC an NBA with a 14 day deadline to pay your compensation.

    However, I would like to add that I think it is worthwhile reading in full the Pre-Action Conduct Practice Direction that Blondmark refers to:

    If you've not taken court action before it will give you a very small taster of things to come.

    The alternative to step 3 (or pehaps to consider after a rejection following step 3) is to find a NWNF firm to take on your claim if you don't want to/can't start court action yourself.

    Why does it not suprise me that Solicitors for the defence are at least 12 months behind development in the law and court case judgements. Argument are being put forward that are so long out of date and not even correct.

  • Cannot believe it but Thomas Cook have paid up and transferred £1032 into our account.
    My claim went in 29th November 2013. On 3rd December they said the delay was a result of circumstances beyond their control. I emailed asking for the exact reason for the delay. Again on 5th December they said the technical fault was beyond their control.
    My last email said they still hadn't answered my question and I needed to know the exact reason for the delay. I had also contacted P&O as the flight was part of a cruise package and they replied saying it was hydraulic damage resulting in the delay. Meanwhile on 12th December Thomas Cook called to say they had re reviewed our case and would pay us compensation!!!! The money was in our account today. Happy Christmas!!!
    So don't give up at the first hurdle.Just keep pestering them and hopefully you too will be compensated.

    I only wish we were all that lucky or it was that simple, they seem to pick and choose what they want to defend. I think they push as far as they can go and then when the evidence is stacked up agaisnt them the pay out but not until the last minute. Anyway post it in the success thread as well to give us all encouragement and the will to keep on, great for you have a good xmas.:beer:
