We started the court process against Thomas Cook and have just received the defence of claim.
I will post the whole document but it looks like we have made some stupid mistakes. We did one claim for our family of 5 but they assert you can only claim for yourself. Any suggestions what we should do?
They now have given us a reason for the delay and it is that the aircraft scheduled to fly us back suffered a compressor case failure on take off at a previous flight rotation and that this constituted unscheduled maintenance, leading to extraordinary circumstances. They then state that a replacement aircraft was obtained and therefore they took all measures reasonable to remedy the faults.
In reality we saw on the internet that our flight was cancelled a full 24hrs before we were due to fly as it just disappeared from the schedule. We rang Thomas Cook who denied this at the time and it was only upon arrival at the airport that we were told of our 26 hour delay.
Surely if they sourced an aircraft it should not have taken at least 50hrs to organise one.
Any help much appreciated as now have to decide if I'm going down the small claims track0 -
Bobsa1: don't beat yourself up over claiming for the whole family. Some folk have done this and had their claim struck out, others have only been able to claim for themselves, and others have experienced no problem at all. It's down to the discretion of the judge.
On the substance of the claim, I think you have a pretty strong case: if the airline had two days to fix the issue and failed, I cannot see how anyone could conclude that they'd taken all reasonable measures.0 -
TC tried to pull this one when I was at Hamilton Sheriff Court. The sheriff consulted a book called McPhail and ruled in my favour. He also remarked that I think Wallentin involved a lady claiming for her husband and child.
Also TC insist on the lead passenger making the claim.

Suprising how many times now I hear the word compressor stall as the cause, this is basically engines worn out. I would like to know the details of this one as there are a number on this site who have had the same thing including me, I know quite a lot about this type of fault now and one thing is for sure
What flight was this? This sound too close to the bone and I suspect it could have been our flight that had the techkie or others on here.
1. knock on effects are not EC
2. Compressor stalls are inherent with jet Engines and tech faults, therefore inherent with the running of an airline.
They should have put on a replacement asap.
3. Use form N244 to add claimants £45
