    1) Check other flight departures/arrivals for same day to see if weather did have an adverse effect
    2) Find other people off flight who can confirm your recollection re the door
    3) Post flight number/time/destination to see if anyone else has been paid out
    4) Then it seems likely you may have to take them to court.

ps Presume you have read FAQ's on Page one.

    Cheers 111KAB

1 )Had a look on flight stats most flights that morning landed on time.

2)Was at a friends wedding there was 10 0f us that travelled on
that flight so others could clarify this

3)flight number is TCX62 sat 9th january 2010 to Puerto Plata
would be glad to hear from anyone on this flight
    Thanks again
  • My party of 6 was delayed by 5 hours from Paphos to EMA. After writing to Thomas Cook and asking 3 times for a detailed explanation of the technical fault I was told that it was a "wing fault". 25 years as an engineer in the RAF leads me to think "waffle". How do I pursue the claim since the CAA deal only with flights originating in the UK.
Also is the delay calculated by gate time, departure time or what?

Pursue the claim either under your own steam by way of small claims court or use a no win no fee.
Delay time is the difference between scheduled arrival and actual arrival time.

Here are the letters for the CAA and the NEB regarding EC's that led to the NEB list.

These docs led to the NEB list
    Thoughts?

  • Am I sitting on dynamite? I have a letter confirming the cause of the delay from a very, very good source. Shall i let TC tell me what it was, or should I tell them? I am waiting for the defence docs so we will see what's in them. What ever it will go in my bundle.

  • When you say claim, can I claim in the UK or do I have to claim in Cyprus where the flight departed? If as you say the delay time is defined by the arrival time then why does the CAA state that they do not consider delays to flights other than those fdeparting from the UK?
Does anybody recommend a firm for no win, no fee?

Claim = court claim in the UK
CAA = responsibility for planes departing from the UK
NWNF = read various other posts and really decide yourself.

After months of fighting with Thomas cook, cases passed to CAA who passed back to Thomas cook, and are still refusing to pay out!!! Think I will need to go to court! 😡

How do I go about this in Scotland, Glasgow? Any help would be great.

    Thanks

FooDoo, I think I made a mistake Only put TC as the name on the claim form and not TC Airlines.
Thomas cook have accepted and said they are defending. Now will they say it's not them but Thomas cook airlines and there is no claim against them, or will they say its us? Legally could I change the name with the right forms or leave it and wait to see the defence? Would that mean i would need to raise a new claim? or just change the name? Confused.

  • Been battling Thomas Cook since February and after taking them to small claims court they are now offering me compensation but only for the 2 adults on the flight, not the 2 children who were aged 13 and 16. I don't feel this is correct, especially for 16 year old , as they pay full price for flight. Cannot find any info on this, only refers to amount per passenger. They have only given me until 4 December to accept their offer, think they're being a bit pushy. Anyone know the correct answer ?
