Had an email from Bott & Co they have received T.Cook formal defence and are looking at it to see where we go from here. Back to waiting with fingers crossed0

I have just received the standard reply from court that Thomas cook acknowledged they intend to defend all the claim and now have 28 days . Whats interesting is that the address for the defence is Thomas Cook airlines Hanger 1 Western Maintenance Area Manchester Airport and its signed by Selina Van den Berg secretary to head of legal UK.
I would have thought their legal dept would be at head office in Peterborough and not a hanger in Manchester Airport .
Has anyone else any thoughts on this ????

I originally got a reply from Thomas Cook Peterborough, then Thomas Cook Tour Operations Ltd Peterborough and then Thomas Cook Tour Operations Ltd Bradford.
To this day, I still do not know what the EC's are - but will get to know soon - bit like waiting to see what Santa is bringing for Xmas!! :rotfl:

Newbie here firstly I would like to thank everyone on here as I have received some great tips and help but i have never posted before.
To cut a really long story short i have been trying to claim for flight txc033 Manchester to Toronto 06th oct 2009. we were delayed 2 hours out of Manchester and once on board we were told that our aircraft had been swapped for a smaller one, so now the direct journey to Toronto would now require an unscheduled stop off at goose bay for re fueling adding 3 hours to our journey time. If that was not bad enough we were further delayed by 75 mins at goose bay. I sent Thomas cook initial claim letter they sent me template response flight not delayed long enough, i sent them follow up letter again urging to maybe actually carry out an investigation 2 weeks later got extraordinary circumstances, after months of emails to and fro to establish the EC i sent NBA got please give us 28 days to respond. Today have had a letter still saying EC, the letter states and i quote
" your flight was initially to be serviced by aircraft registration number g-fclk. at approx 12.30 hrs it was noted that there was a number 2 engine bleed and the air pressure was low during idle thrust setting. This would prove hazardous as the conditions at yyz were confirmed to be icy. a problem with number 2 engine is highly unusual and required engineers to investigate further. at 13.25 hrs high engine runs were carried out by engineers it was determined the a pilot valve needed replacing. At 14.20 hrs the engineers determined that it was the pneumatic sensing line and therefore would take longer to rectify"
so basically at 14.20 hrs they decided to get another aircraft in, but we were not due to fly out till 16.30.
So anyway I am just wondering is it worth pursuing this further i.e court or is that classed as an EC under the new ruling. I no i said short version, i promise you this is.

It may take a long time doing a small court claim ms_james, perhaps have a read of what has happened to others in this thread and decide if you have the time and tenacity to do a claim, if not consider using Bott & co instead.Posts are not advice and must not be relied upon.0

That is what i am considering at the moment but did not really want to waste any ones time if i did not really have a chance of winning0 -
The only time wasters are TCX, because they didn't have a back up long haul aircraft!

I hope someone may read this thread that was on a flight from Gatwick to Tenerife around 2nd July 2008. My son went on holiday with about 20 school friends after their exams had finished and were due to fly out around 6pm but were informed that there was no fuel so they flew out the next morning which meant that they lost one night of the holiday. When he got back I wrote to Thomas Cook on his behalf but got a standard letter saying the usual beyond there control. The problem I have is that I do not know the exact date of the flight out although I believe it could only be a couple of days either side of the 2nd July, I have looked on flight stats website and a flight TCX 18 matches the times but states Tenerife North rather than South. He did not book up the holiday so we have been unable to find a booking reference but have asked the mother of one of the group that made the booking but have had no joy. Hopefully someone may read this who was on the same flight.
If I fail to find out the correct information does anyone think I may have a chance with the no win no fee companies mentioned in this thread being able to find out the exact flight. I still have a copy of his old passport number but as yet have been unable to use this to assist in finding the flight number.0 -

You will need to do a Subject Access Request under the Data Protection Act - Will cost £10. Ask TC for everything they hold.
