    Yes, unfortunately I wouldn't have a clue where to begin and with a family to look after I don't have the time. Some money is better than no money. Like you said and I very much agree with, shame Thomas Cook don't just pay out to begin with.

    Alot of people will get told 'no' from Thomas Cook and therefore would walk away. I'm sharing my good news to urge people to keep on with it and if you don't have the time/knowledge like myself to go to court yourself at least there are companies that will help you. You may have to pay 27% plus admin of 25 euros pp but still I'm getting £750 odd pound more than I did have :)

    Just received a letter from TC's solicitor offering to settle for £1335 in advance of our court hearing on Friday.
    Very pleased obviously about not having to prolong the agony but this does fall someway short of the amount we were claiming i.e.
    400 Euros x 4, plus interest from 2011 (at 8% normally), plus the £71 small claims court fee.
    Do you think we should just agree and be done with it or hold out for the full amount?

    There's no guarantee that a judge will award you interest, and certainly not at 8%, so there's not much in it IMO.
    I'd say £1335 plus the small claims fee of £71, - CLEARED FUNDS IN YOUR ACCOUNT BY FRIDAY - would be a good enough deal to settle at.

    I suffered a 5 hour 40 minute delay on a return trip from Paphos airport. My understanding and wrote to Thomas Cook back in January. My case was that we were told the delay was the result of a technical fault at Larnaca, this required a spare part to be flown in. As a result the plane lost its slot and eventually flew to Belfast befor going to Gatwick and on to Paphos. Thomas Cook's final response after a couple of standard letters was:
    Summary of delay for CRE purposes:
    Due G-CRPH AOG Delay 05.40 Nil past history on this defect in past months. Aircraft aborted T/O with No1 Eng. COMP VANE' message and had no N1 acceleration suggesting a VSV problem. Considered an extraordinary event that can be defended. Crew encountered 'No. 1 Eng Comp Vane' Msg and 'LH HP Fuel pump and FMU' messages. The rejected T/O resulted in MW fuses blown.
    I wrote to the CAA and then Cyprus CAA in April but haven't heard anything back, the last response to my progress enquiry was "no technical report yet received". This 6 months after I wrote to them.
    Anyway my argument is that technical faults are not extraordinary, they carried insufficient stocks of spares and they had ample time to arrange for another plane to pick us up on time.
    Sorry for the lengthy message.
    Do you believe I would have reasonable chance of success if I took them to the small claims court?

    Hi, I am a newbie to this forum and am trying to claim compensation for a flight delay of over 6 hours at Gatwick flying to Heraklion to join Ocean Village cruise on 24th July 2008.. Flight was TCX 709. Is there anyone out there who was on this flight?

  • I've been haggling with Thomas Cook for over 12 months for compensation for our flight delay.
    I sent my case to the CAA. The CAA sent me an e mail stating that Thomas Cook had agreed to pay us compensation.
    Despite sending numerous e mails to Thomas Cook, I have heard nothing from them.
    A new website is willing to issue proceedings for people who want to claim compensation.
    They offer a no win no fee service.
    I could have saved myself a lot of time and trouble by letting this site deal with my claim.

  • I have just received the standard reply from court that Thomas cook acknowledged they intend to defend all the claim and now have 28 days . Whats interesting is that the address for the defence is Thomas Cook airlines Hanger 1 Western Maintenance Area Manchester Airport and its signed by Selina Van den Berg secretary to head of legal UK.

    I would have thought their legal dept would be at head office in Peterborough and not a hanger in Manchester Airport .

    Has anyone else any thoughts on this ????
