    Most of the templates are in the FAQ's. It depends what you want to write now, having received the EC excuse. Most people would now just go straight to court as further correspondence might well be pointless.
    But it depends on what you wrote in the first place. If you didn't put them on notice that you would go to court, and that you urge them to reconsider, or you will do in 14 days, as their excuse doesn't fit with *the relevant passage of the EU261 regs/the Sturgeon judgement/whatever* then that might be better to write at the moment.
    Have you posted what the excuse was?
  • If fortunate enought to receive compensation how is the exchange rate calculated? If awarded 400 euros is the exchange rate on the day of decision or can they work out the exchange rate on the day of the flight? Just wondering because it could vary quite a bit.
  • Help wanted!

    Long time reader, 1st time poster etc!!

    Me & 7 friends went to Crete & our TC flight returning in July 2005 was 7 hours late.

    I sent the template letter with a 14 day limit to them a month ago together with a copy of the holiday invoice stating flight numbers & passenger names etc.

    I've had no response & I have read that the time limit is 6 years for claims in court, so obviously it's over that. As we were only 19 at the time, we viewed the delay as an excuse to stay on the lager for an extra 7 hours, so never complained at the time (think we were uninsured as well).

    Any ideas what I should do next?

  • My earlier entry I stated that I received a cheque to the value of £710. On further examination it is not a cheque but a credit note towards another flight or holiday. I am still happy with this as it will give me another holiday later this year.

    Having trouble claiming through Thomas Cook for a 9 hour delay in Bristol airport following the above flight being delayed, which we were told was caused by one of the computers failing a pre-flight check. Another plane had to be flew in (eventually). I've been backwards and forwards with TC, originally correspondence was with someone with an Indian sounding name, but it seems it has been passed on to their British cust services and I have had the following response

    I was very sorry to read that I have been unable to resolve your complaint to your satisfaction and I have taken the liberty of reviewing the information concerning your flight delay.




    Unfortunately, having done so, there is nothing further I can add to my previous correspondence, where I have attempted to address your concerns. Whilst I understand that you believe that the delay was not caused by extraordinary circumstances, I can confirm that the root cause of the delay could not have been foreseen.



    It is regrettable that we have been unable to reach a conclusion on which we can both agree. However, based on the information I have available, I do not feel compensation is appropriate in this case.

    I trust I have clarified our position, and I am sorry we have been unable to amicably resolve this case for you.
    Any assistance or advice would be great.

    I have just sent a complaint to the CAA, hopefully they can work some magic.

    In December 2011, I was delayed for over 24 hours with thirteen other people in my party including two registered disabled and one 2 year old baby.

    We were about to take off from Barbados and as we were about to lift into the air we came to a sudden halt and had to be towed back to the terminal. Apparently the pilot informed us the primary and secondary seals had gone on the hydraulics and the steering failed.

    They kept us on the plane for over five hours as they tried to find spare parts and we found out they were even trying to take them off another plane. We also found out that the officials at Barbados airport were refusing to send steps and buses to take us off the plane as we would become their responsibility once back in the terminal.

    So five hours later and one screaming hungry baby (they gave us one orange juice and one cake in this time) they had no choice but to take all 300 of us off. We got to the terminal and it was total chaos with one person from Thomas Cook and one desk trying to sort out hotel accommodation. We had to re-collect our entire luggage but I won’t go into the rest of the over the overnight escapade as that is not part of this claim.

    I have sent the first template letter to Thomas Cook and got the normal “Extraordinary Circumstances" standard letter back. I have sent all details to the CAA and am just sending Thomas Cook the second letter giving them 14 days before court action, telling them not to send me another standard or holding letter and I have asked them to explain what the Extraordinary Circumstances are on this occasion in preparation for legal court action.

    I also have legal cover on my home insurance so will be getting a solicitor to deal with it. Incidentally I am sure the extra legal cover most people have on their car insurance can also be used. Most people pay twice when they are both the same insurances.

    I will let you know what reply I get from them. :mad:
  • Hi, I have completed the form and sent to Thomas Cook in November but I constantly receive an automated response stating they are looking into my claim in the UK and overseas. I have now give them 48 hours to respond with a satisfactory outcome or I am taking them to court. Please advise of next steps to commence court proceedings. We had our flight cancelled and were delayed for 12 hours with no accomodation, no food or drink and no rep to advise. We ended up flying home with Jet 2 (and hungry tummies!) which replaced the TC flight.

    Can anyone offer a bit of advice regarding an 8 hour delay in August 2010. Flight from Manchester to Egypt - apparently this is about 4000 kms. The airline staff told us at the time that reason for the delay was to join our flight with a later flight - a 747 plane was used to fit us all on.

    There were 5 of us in our party and the delay was a nightmare, we live 20 minutes away from the airport but were told we had to check in immediately or we would lose our chance to book in.

    I don't have any boarding passes or tickets. But I do have an email confirming our seat reservations. This shows our flight number and the seats that we paid to reserve - would this be suitable evidence?

    Our flight was TCX657K - anyone else on this flight?

    Thomas Cook seem to be a nightmare to deal with.
  • Hi we travelled on the 28/06/12 to Dalaman from Gatwick TCX1642
    Meant to leave at 10.30 delayed until 7.30 due to the plane getting damaged when it came in and hit the docking thing. They had to wait for 1 plane to come from manchester to pick up some and get another one for the rest of the passengers. We booked through travel republic but was a fly thomas cook flight so could i claim and would i be eligable to claim for the 4 of us compensation through thomas cook.
  • I have previously wrote to Thomas cook in relation to my delayed flight to Cyprus. Can anyone help me find the exact amount of time that we were delayed for flight TCX6274 Newcastle to Larnaca, Sunday 16th Sept 2012. I am positive it was around 4hr 30mins but unsure.

    I received a letter from TC stating that we were due compensation and was given a voucher to the value of £630, I have read others comments stating that they have been given the same discount vouchers for another holiday. I am not happy with this and would prefer the money as I have already booked my holidays for the year and it is not with Thomas Cook.

    I also thought I was entitled to £480 per person in the party as Newcastle to Larnaca is more that 3500km and we were delayed more than 4 hours. Am I within my rights to ask for the full amount that the guidelines on MSE say that I am entitled too?

    I would be grateful for any advice as I am completely stuck with what to do next :(
