  • Well, surprise surprise. I have just spoken to my solicitor and TC want to apply for a set aside regarding the default judgement on them as it would seem they didn't receive the original court documents and they don't think its fair!
    Funny how many times these court documents go missing isn't it where Thomas Cook are concerned?
    We are not going to go along with it and are contacting the court to persuade them to let the judgement stand. As far as we can see there are no grounds for them for a set aside as we informed them quite clearly to expect the court papers to be delivered to their head office. They must know what they look like by now eh?
    Another time wasting lie by the lovely Thomas Cook.

    Think I'll have that glass of wine now JPears.

    Did you read ANY of my many other posts where I think i've been incredibly helpful to others (including new users) as others have been to me, so I do take great offence at your remarks.
    You say in another post that you don't think people are being lazy in not reading the FAQ's but thats exactly what it is. Why should I spoon feed new users such as yourself with information when I, and many other users on this forum have done it the hard way? The information is easy to find so I can't say I believe you when you claim to have read 100 pages. The airlines won't make it easy for you to claim so you will need to prepare yourself for a lot of hard work starting now.

    A good example of mine (and others frustration) of quite frankly unnecessary questions came the other day when a new user asked what to do after the airline rejected their claim. Many people told them to "read the forum". I told them (quite helpfully and politely) to sent a notice before action and then proceed to MCOL.

    Their next post was to ask what a NBA was!

    Literally the very next post by a different new user asked the same question about what to do? The answer was on the same page.

    Its unnecessary questions like these that clutter the forum and make information harder to find for everyone. Including yourself.

    I actually think this thread should have been locked about 100 pages ago. The information you required would have been much easier to find and it would have saved you from being offended by such rude forum members such as myself.

    If you think that post encourages people to ask questions then you must come from a really strange place.

    Have you considered people who may have reading difficultiies meaning they would really struggle to read through 200pages, are they not entitled to reclaim if appropriate. To fob someone off with "read the bloody forum" is downright rude whichever way you try and dress it up.

    I'd say that was more of a tongue in cheek remark than rude and again, if you had seen that letter published on here as many times as I have you would understand.

    You seem to one of those socially unaware people that would rather start an argument with me for no reason (quite rudely I would say) than make any useful comments that could help other people. Do you have any thanked posts? No. Because all you're doing is whining at me for most of them. If you're so worried about helping new members then do your homework and give them some advice.

    I refuse to be drawn into this anymore. Any further posts by you will be ignored by me and I hope others.

    Just a note of thanks for all the advice and encouragement given to me on this forum, in my quest for compensation from TC.

    It has been a long road but they have settled in full prior to going to court.

    If I can be of any help to any others in making a claim against TC re. this flight, feel free to pm me.

    TC have claimed that they didn't receive my original court documents being served on them (but they got the default judgement, funny that) and are applying for a set aside.
    Clearly they seem to do this to everyone so would it be possible for anyone who has had delayed or ignored court papers to PM me so I can get proof that TC are playing games and deliberately ignoring court papers? If I can show these to the court then they hopefully should let the default judgement stand and throw out the set aside request.
  • Hi Guys,

    Came home today to 2 letters from the court - basically one is the instructions from my hearing stating that I have to send in an amended particulars of claim by the 7th October!!!! - Thanks Vauban for all your help. I did get this in on time before anyone asks!

    And goes on to say that another directions hearing will take place on the 4th November.

    The other states that the DJ orders the claim to be stayed until 5th November 2013 to enable the parties to attempt settlement.

    it then sets a deadline of the 19th Nov for me to notify the court of settlement or for TC to extend the stay or all parties to file a completed directions questionnaire.

    Does this mean the hearing on the 4th is now cancelled? What should I do regarding the second letter?

    Vauban, Chili, Mark 2 Spark, Jpears and last but not least centipede have helped me massively over the past few months I won my day in court and received the cheque today I'm £682 richer because of the great support you and the many others gave so keep giving the support you have been giving, I wouldn't have gone to court without your help
