    Well, long story short i'm still waiting. I have a solicitor appointed by my home insurance legal cover working on my behalf but have been at them for compensation since February 2013 for a delay in September 2012 from Antalya to Gatwick.
    As they ignored the court summons we have applied for a default judgement which we got. I'm just waiting to hear from my solicitor if they have replied to the 14 day deadline to cough up the compensation or we will enforce the judgment and send in the bailiffs.
    I'm not holding my breath. As you have found out, TC widely ignore court deadlines and make up weak excuses as to why they haven't met them. And they seem to get away with it too. I'm just waiting for the set aside request from them because they didn't receive it/it went to the wrong address/department or the dog ate it.

    Yeah, they're shockingly bad aren't they? My parents got a default judgement against Monarch recently and they coughed up so hopefully you'll find them same.

    I recentley made a claim for delayed flight TX2196 which was delayed on the 19th Sept 2013. I lodged the claim on the 1st Oct and had a responce on the 9th Oct. For the 4 people they gave £1380 compensation. Thanks for your advice

  • A friend was delayed at menorca on the 24th August for 5 hours 50 mins there claim has been rejected. Can they take it up with CAA or do they have to contacted Spanish Authorities.

    Spanish authorities, which is AESA.
    Not that it will do any good. TC won't reply and they will then find in your favour.
    What then?
    TC will then deny any further letters from you stating the AESA findings.
    What then?

    The penny might drop soon.... off to court you go... ;)

    Flight No TCX 2107 Majorca to Manchester 5th May 2012

    Hi, really heartening to read of so many successful claims, I've just received the standard "car repairs" email response. I have read a lot of the thread but opinions seem to have changed along the way, eg it would now seem futile to go to the CAA/AESA and that I should now start the MCOL process, here's hoping.

    Will update as and when.

  • So, surprise surprise, we were meant to receive our pack of court docs from Thomas Cook today and have received nothing - anything we can do or do we just sit tight and wait for the court date?

    I didn't receive a pack and then they called me the day before the hearing to settle.

    Not getting your hopes up, but maybe that will happen.

  • Hope this is useful to anyone else on this delayed Thomas Cook flight. Hopefully, ‘gorses’ will read this post.

    Firstly, many thanks to all the expert advice and information from MSE! I did indeed read all the numerous posts (including the ones regarding “not having to accept holiday vouchers!”)

    The entire process took approximately 14 weeks from my initial letter to £702 BACS payment into my bank account.

    My initial letter was posted to the Peterborough Registered Office, but apparently, was never received! After contacting Customer Services on (01274) 387991, it was explained that if I e-mailed all further correspondence to Customer Relations, it would be dealt with by them. My first letter was answered with the standard ‘technical nature, extraordinary circumstances’ reply. I rejected this and e-mailed a second letter with more information relating to the fact that the aircraft which was due to take us to Antalya, was in fact on its way to Cancun from Glasgow, hence the need to charter a Thomson aircraft (information which was relayed and confirmed by Thomas Cook and Thomson staff at Manchester Airport). I explained that flight TCX2994 was quite infamous throughout Manchester Airport during the Summer of 2012, as it had regular delays and at one stage, police had to be called to deal with angry passengers who had been informed of yet another delay - as reported in the Manchester Evening News.


    My second e-mail was then taken more seriously and within 1 week I was offered £702.00 in holiday vouchers, which I rejected. I was told that a cheque would be raised for the amount. Thankfully, only after reading more posts on MSE, I became aware that cheques were not being issued and that BACS payment was now the preferred method of compensation. After contacting customer services again on the above telephone number, I received an apology e-mail and the full compensation was paid directly into my bank account.

    Unfortunately, we were also delayed on the return flight, TCX 2995 on 27 August 2012, but Thomas Cook would not accept liability for this one.

    I do hope that someone finds this rather long-winded post helpful and apologies for the late posting! :)
