Hi I have write to Thomas Cook regarding a 12 hour delay on a flight to Turkey in August 2011, I have just received the following reply back and wondered whether you could advise me if I can do anything?
:Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s.
In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case.
When we eventually did take off despite ordering in flight hot meals we were served the same as everyone else, cold snacks, plus within ten minutes of the flight the toilet at the front broke causing a terrible smell for the rest of the flight!

Start with the FAQs on page one, and basically continue reading from there. Or contact a NWNF solicitor - who'll take about 30% of the claim if you win.0 -
May I make a suggestion....
If someone has WON a a SUCCESSFUL claim against Thomas Cook and been paid compensation... PLEASE put the flight details, flight number and date/time of said flight on your success post heading so others will know...and the post can be traced through the search engine on the site. Lots of successes are being lost in the forum due to no point of reference.
The fact that a precedent has already been set, that compensation has already been paid and an admittance of fault already made by T Cook,may be supporting evidence in other forum members claims for the same flights.
..... and if there are any members of T. Cook on the site.... it would be more cost effective to admit liability and pay up if you are at fault... you are losing customers and income in wasting court time your own barristers time and our time.
Recommendation, fairness and good customer service goes a long way to repeat custom and is cheaper than advertising. Right now I would not touch T. Cook or its subsidiaries with a 10 foot pole!0 -
Hi.
I submitted my TC claim in Aug for a 23 hour delay to my flight from Calgary to Manchester TCX 313 on Sep 11th 2011. Anyone else on that flight?
At the time we were given a TC letter and I contacted them to claim compensation for losing income and other expenses incurred due to the delay (not knowing about the EC ruling) TC told me they couldn't help and advised that I contact my travel insurers.
I have had the "we can't find your details" reply and I yesterday received the standard "mechanical failure / extraordinary circumstances" reply. I was wondering when to do next. Then I saw Watchdog and put my complaint into CAA this morning.
Then I found this forum and read the FAQs
So my next move is NBA. From what has been posted here, it seems prudent to do that immediately rather than wait for a CAA reply that may not be of any use. Is it best to post the NBA recorded or signed for mail ?

I have waited over a year for the CAA to reply my court case has been and now gone , just file your claim,good luck0 -

Although proof of posting is not proof of delivery! I emailed all my correspondence with a read receipt. Cheaper still and you know that they have received it.0 -

Hello, pleased to tell that I successfully received compensation for the following flight details;
TCX7128 to Tenerife on 23/08/2013.
The flight was 17 hours late because the first aeroplane from Stansted had a fault with the aircon. We were then moved to a later aircraft which had to go via Gatwick in order to do a crew changeover. Whilst waiting at Gatwick we were suddenly ordered off the plane as the Captain saw smoke. Much panic and people exiting via the emergency escape chute. We had to stay overnight at Gatwick and eventually flew out the next morning.
I'm pleased to say that TC did not put up any argument about the claim for myself and 4 other passengers.:rotfl:0 -

What address is successful for court papers for Thomas Cook Airlines Ltd? Co House says Peterborough and yet someone on here has posted Bradford?
Can't believe TC, so someone who has had a success please!

I aways emailed the director's office with a letter attached. Seemed to work ok for me. They didn't pay up but at least they couldn't claim they didn't receive it.
Whatever the ballace of probability of them getting a letter in the post I would still pay the extra 50p for a signature so there was no argument. Especially after they constantly ignore court documents including mine. Bet they say that it wasn't delivered. If only the court would post recorded! Sigh.0
