I recently won my claim against Thomas Cook for a delayed flight last year
What do you mean "won" - not in court presumably. Do you mean they simply agreed you had a claim?but they have only offered me vouchers I can use with them up to the value of £600 does anyone know if this acceptable
If you'd searched "vouchers" you'll have seen this answered loads of times before. Go on - have a go ...or should they offer me money aswell
You want money as well as vouchers? That might be pushing it. But you don't give any details about the delay, and that will affect your entitlement: how many people, how long the delay, and over what distance.0 -

I won !
The judge was not impressed with TC submitting
Late evidence , they also omitted the engineers witness statement.the barrister could not use extraordinary circumstances even though she tried as she could explain what the actual problem was with the
Aircraft hence she wanted an adjournment.This was refused on the basis
The hadn't adhered to the courts strict guidelines in supplying the correct
evidence /bundles and as there was no written statements then any oral statements from the engineer wouldn't be allowed either.
I was given quite a hard time by the judge however as the couldn't explain
What they actual problem was with the cracked screen it could have been a multitude of reason some extraordinary some not he decided in my favour
At the opening of the hearing TC dropped all of there claims except the extraordinary circumstances claim. I was up against a barrister TC had instructed I have won £682 she even contested the exchange rate the judge overruled this they have until Oct 23 to pay.
Thanks for all your help everyone on here has been really good and some great advice
The CAA letter was very useful judge took notice of it and as my flight wasn't listed judge thought it can't be a serious fault or even a smokescreen

I apologise if I upset some others on this thread I was simply looking for some advice from those that have already been through the same issue with Thomas Cook. I am most certainly not looking for FREE legal advice, perish the thought.....just some simple pointing in the right direction would have been nice. I thought that was what forums were for. However I will try and find out some other way now. Or just maybe blunder on in the hope something works out for me.

No apologies necessary but the best advice I can give is start at the first page of the forum and start reading! Most new forum members might see this as old information but in this case it isn't, its the same info over and over and over where people keep asking the same questions!!! And don't bother will the CAA. Just send TC a 14 day notice before action letter and then take them to Court if they don't pay up. Which they won't. Or use your home/car insurance legal cover or a NWNF company to do it for you.0 -
Hey all,I'm about to hit tc with my claim and owing to the uncertainty raised in the above posts just wondered if someone can tell me exactly what ,who and where I should send it to please.Also if there's a email address to send it to as well that would be great.or if anyone can advise if email or snailmail is best.

TC have this week acknowledged my daughters claim with MCOL, they have informed the Court that their 'defendants' name is:

Oh and the reason she will not be getting any compensation for an outbound delay of 4hrs 30 mins and inbound delay of 30hrs 10 mins is 'was a result of circumstances that were beyond our control' !0 -

However, don't waste your time with CAA, they will take MONTHS to respond and then palm you off with some excuse.
Get your NBA off to TC then start legal proceedings.
