How should I proceed from here?
Should I send another letter with a copy of the AESA letter, along with a demand for them to explain the circumstances or should I go straight to court?

NBA and then (assuming no positive response to that) issue claim.

I understand Galasteve wrote an NBA in to the airline in April, giving them 14 days notice of legal action. Not sure why he didn't follow up - but I don't imagine his threats to start legal action now are going to be credible or much noticed by TC.

I think it will be interesting, but I'd manage your expectations if I were you. What "good news" are you expecting? The companies seem pretty impervious to public shame, so far as I can tell.

I'm sure that you are right. It will be lots of flannel about how much they sympathise with passengers but the law is in their favour (yeah, right!) as "proved" by recent "guidance". A waste of time, sadly.

I just never got round to doing much as I was waiting for the AESA to get back (took 3 months after me prodding them). I sent my NBA letter but never even got an acknowledgement from TC. I assume that, as I sent that letter previously, I can just start a claim without sending another?

I saw that. I think he was persauded to try AESA first.

  • Hi can someone give some advice please if they can.

We were delayed for 8 + hours flying from Glasgow to Heraklion on 3rd Sept this year but when I wrote to Thomas Cook I have had the letter back rejecting the claim as it was "exceptional circumstances". This was due to a technical nature they said plus they do maintain their aircraft etc etc. is my next step the CAA.
If someone could give me some advice I would be most grateful. We actually saw our aircraft sitting on the Tarmac and then it took off empty so it looks like it was deployed elsewhere however we have no proof of this but it was at the same gate we were told to go to.

    Thanks
  • Sorry I'm new to this site and don't know if I'm posting in the correct thread

I recently won my claim against Thomas Cook for a delayed flight last year but they have only offered me vouchers I can use with them up to the value of £600 does anyone know if this acceptable or should they offer me money aswell

Vouchers and money as well - good idea but you won't get away with it! There again TC should be giving you money not vouchers so don't let them get away with it.
