  • I am pursuing compensation from Thomas Cook from October 2008 when we were stuck in Crete with a 21 hour delay.
    We were eventually taken to a dodgy hotel near the airport at 2am and were there until 4pm the next day.
    Our flight to Leeds finally took off 21 hours late!
    There were 2 adults and 1 child on this holiday.
    Thomas Cook have admitted there was a technical fault and they are willing to give me £150 voucher off my next holiday with them!
    Is this fair compensation and if not what's my next move?

  • Thanks, I'm not sure what I'm looking for in FAQ, I've already contacted the CAA, because the delay was in Greece they told me they couldn't do anything, so I contacted the Greek CAA and they just told me I could claim, not how to!

    Please read the FAQ before posting! I will give you a hint. The very fact that Thomas Cook have offered you anything means they know they are in the wrong and should be paying you £1000+ for your claim. DO NOT accept vouchers of any value. You are owed cold hard cash. Do your homework and tell them how much they actually owe you or take them to Court.

    Hi - this is a bit of a long shot I think, but I would be grateful of some advice.
    My family and I (5 of us) flew to Sanford, Florida in 2008 with Thomas Cook and I remember being delayed 2-3 hours outbound. I remember it being announced that they needed to replace a part on the plane and there would be an hours delay leaving. We left the gate to go back to the departures lounge and have a look around the shops, only to return to the gate and being told it was going to be another hour or so.
    Anyway, having heard that it is now possible to claim some compensation, I found our tickets and had a look on the FlightStats website, only to find that the delay was not how I remembered it - either my memory is not as it used to be (highly likely!) or the results have been entered wrong?
    It states:
    Departure Sched 9.35am
    Actual 10.30am
    Arrival Sched 11.35am
    Actual 3.00pm
    Status Landing 205 minutes

    Now my question is - how can a plane that only left 55 minutes late, be over 3 hours late landing? (other stats for that day include a Monarch flight that was 5 hours late leaving and yet only 50 mins over schedule. Is it worth me putting in a claim?

    Hi go with your memory. I had the same thing, it said my flight was on time and we had a 9 hour delay, they had to fly a plane from England to Sanford to collect us but still the stats said it was on time. I had a response from Thomas Cook yesterday to say they were giving me a partial refund of £343 each (6 people) but by vouchers. I'm so happy because I sent them an e-mail back asking them to explain why I wasn't entitled to the full compo due to the flight being over 4000km and over 7 hours delay and that I wanted payment in cash - they called today for my bank details to do a bacs transfer for the full amount. Stick with it so long as you have confirmation of booking or boarding passes (mine stated that they took off on time too) or any other proof of flying or purchase, then you should have a case.     Many things could affect the flight time of the plane, for a start you were almost an hour late taking off which means you might have had to be put on a different flight path at a lower altitude which will affect airspeed. Also things like head/tailwind can slow down/speed up flight time considerably as well as the fact you might have been held in a holding pattern after missing your landing "slot" upon arrival?

    After finally connecting with the TC thread and finding another poster who had successfully claimed for the 8 hour delay on this flight (I had tried 3 years ago and was refused) I sent off another letter to try again.

    Bingo - I received an email today (obviously a copy of a letter en route to me as we speak) offering me £690 in vouchers (" I have taken the liberty of enclosing a discount voucher" ). I have of course asked for cash instead!

    Thanks to all the helpful members who have passed on so much useful information and especially 8904jo - who initially did the all hard work and made my claim so much easier - just keeping my fingers crossed that my cheque arrives now.

    Can someone please help me and point me in the direction of a SAR template I can use to get all the info Thomas Cook hold about me as they are claiming they have NO knowledge of us, yet we fly with them every year.

    I have a couple of templates but not sure what wording is officially needed and the fee to include for the information.
