Has any one got any thoughts about post 3535 that I placed on here the other day. It would be very helpful to have some feed back as I am heading to the time I may need to write to TC again as their 14 day period is coming to an end, and as you will expect I have not heard anything from them.0

Ive been communicating with Thomas Cook via email and post the last letter was a NBA for an 8 hour wait while the flight was delayed and then cancelled
They are standing firm on extraordinary circumstances.
The only snippet of information they have given re the fault is oleo seals replaced.
I really want to give this my best shot but have never done anything like this before.
I've registered with MCOL and thought this was the next step, but now I'm
reading about CPR 18 on the forum.
What should I do next? They are being very frugal with the cancelled flight reasons which obviously is to make me unsure whether to proceed.0 -

Looking for help, this may already have been posted but I can't find any information.
We have been told by Thomas cook that we are entitled to compensation with the eu ruling. They sent us a voucher which we refused so they said said they would do a bank transfer in 10 working days. Anyway 10 days later and guess what? No payment so I called them today they apologised and said it would be another 10 days:(
I was wondering if anyone else had experienced this.

So just spoke to mcol no application form from TC to set aside yet application form was requested from them on the 30th August delaying tactics or what even the lady I spoke to said that if I've sent it to registered address which I did then there's no reason for it to be set aside she also agreed delaying tactics I Am NOT GOING TO GO AWAY TC hope that if it does go infront of district judge he will also see this0

Typical delaying tactics by TC. Awarding you vouchers without your prior consent is a breach of EC 261/2004. I would ring them, tell them straight that if funds are not in your bank within 48 hours you will commence legal proceedings to recoup additional expenses incurred in chasing this claim, and report them to the CAA. Once you have got your money I would certainly bring it to the attention of the CAA, and enquire what sanctions they propose to impose on TC over this infringement. The whole idea of EC 261/2004 is to improve air transport for us consumers, until greedy companies such as TC are forced to meet their legal obligations, this ain't going to happenHi

What shows up on mcol? Does it show as setaisde or still your default judgement? If judgment then I would get court order and send the baliffs in. What is the total of the claim? More than £600? If so send the sheriffs in, not the baliffs. Yes they had a application form sent out on the 30th August and have not recieved anything back yet and there turn around for this application process is 48 hours so they Are either delaying on purpose or it could be that they gave had to reopen as the caa asked them to look at it again so might have done that before paying out the £80 for set aside application god knows becoming increasingly frustrated though I would have thought them having a judgement issued against them would have got there butts into gear guessing they don't care0
