Flight delay and cancellation compensation, Thomas Cook ONLY

  • Having read in the Daily Mail yesterday about delayed flight compensation perhaps someone could advise me.

    In 2010 we flew to the Barbados with Thomas Cook to join a P & O cruise, the cruise was booked with P & O through a travel agent, the flight was a P & O charter with Thomas Cook. The flight was delayed by 6 hours at Gatwick due to a technical fault. If I want to make a claim who should I contact in the first instance P & O or Thomas Cook?

    Well just logged onto mcol to see if anythings changed (requested judgement yesterday by default) and its still saying requested wonder when this will change do mcol even change it online ???

    Probably take a couple of days, I wouldn't waste anytime logging on until end of Monday earliest;) Whilst MCOL is online, the back office that runs it appears to be very much "offline":)

    We claimed for both of us on the one mcol application, as far as I'm aware if you're on the same booking only one person is required to claim on behalf of the everyone (provided they have consent) but I'm not 100%.

  • We were delayed 5 1/2 hours on a flight with Thomas cook from Turkey to Gatwick in July 2012. After being picked up late from the hotel and finally arriving at Antalya airport we only knew of the delay once we tried to check in. There were no Thomas cook representives at the airport and we were told that our plane that we were due to fly on was broken and they were having to send two smaller planes from somewhere to take us home. All passengers would have to be split onto two different flights, one leaving at an earlier time and one not till the early hours of the morning. After fighting for two hours to get onto what we thought would be the earlier flight (having 3 children the youngest being 11 months at the time ) we were checked in and sent through passport control. No offer for vouchers for food or drink were given and no representives from Thomas cook were there to give any infomation. In total we were in the airport for over 7 hours and in the end the earlier flight we were booked on was delayed again and took off at the same time as the later flight. in total we arrived back at Gatwick 5 & 1/2 hours later than our original planned time.

    We were a party of 7 people flying together on the same flights and booked on the same holiday however we were booked under two different booking references to allow us to fit in the hotel rooms. My mum and dad and my son on one booking ref and my husband, myself and two daughters on the other.

    I have filled in the complaint form for compensation from this site and sent it off to Thomas Cook. Firstly we both recieved the letters stating they were opening our case but now have both recieved the standard letters stating no compensation is due.... The difference though is the letters are the same apart from the reason that they are giving as to why they are not paying out. One letter states it the usual technical issues and the other states its due to adverse weather conditions!!!

    There cannot be two reasons for the delay and as all of us were on the same flight I know that it was not due to adverse weather conditions. They have made a mistake by sending out any excuse they can and cannot even get the letters right for both of our bookings.

    I have sent a letter back now to Thomas cook stating that im very disatisfied with their response and their poor customer service is still continuing. I know they are only trying to fob me off and ive told them it wont work. Ive logged a complaint now with the CAA to try and find out the real reason for the delay and advised them I have done this.

    I am awaiting both their response's.

    Does anyone have any info they could share with me on this to maybe help with my case, anything would be much appreiceated. thank you

    First you will need to know why you were delayed, TC will have sent you a reason, secondly you may need to find your flight info, plane type, reg etc. When you have this search the net for known issues with your type of aircraft, has it happened before? does anyone else have the same issues on here.? TC should give you a reason, that is the key.

    You are being fobbed off.
    1. Send a template letter including NBA with 14/21 days notice then commence legal proceedings if no payment after NBA notice.
    2. Don't waste time with CAA. Useless
    3. Start serious reading and reading and reading thru the FAQs and various threads. You will have to wade through alot of useful stuff (and useless repeat questions)
    And don't tell TC that you have received 2 different excuses for the same flight. Keep that powder dry for when it gets to court - Judge will not be impressed as clearly they are either economical with truth or don't have the faintest idea.

    Just got the standard fob off despite asking for the specific reason.....
    "On receipt of your initial claim a full investigation was carried out by the airline into the circumstances surrounding this delay. This investigation included analysis of historical maintenance data, discussions with engineers, and a review of the activity of our other aircraft at the time. Following this thorough process we remain confident that the technical fault was extraordinary and that we took all reasonable measures possible to avoid the delay in question."
    From what I've read on here TC are unlikely to supply me details of the actual fault.

    I have the aircraft type from flightstats but I'm not sure it's correct as TC ended up using a Thomson plane and crew to get us there. Where would I get the reg nos?
    Can I ask the experts here if it's possible to outline how best to build a case?
