Flight delay and cancellation compensation, Thomas Cook ONLY

Why would anyone think that the next action would be to send the airline another letter?!
What was Einstein describing when he said, "Doing the same thing over and over again and expecting different results"? 'Nuff said.
Ok... thanking you for your most helpful response...
My reason for debating whether I should send one more letter, is to give TC 1 last opportunity to compensate me prior to taking the claim to court. One more letter in response stating that a mechanical fault like a fan balde is not extraordinary...
Just a thought. You obviously dont agree.
Nuff said x0 -
(without unfortunately having the time to search this forum from beginning to end...)
Has anyone had to go ahead and file a claim for compensation through a small claims court against T.Cook?
What are the success rates / stories?0 -
Jeez Alberto, do you still go round your mums for dinner as well? :undecided
You don't have to search the whole forum. The court success thread would be a good start.
Or google TC and court. Jeff Halsall was the first one many months ago and it was in the national press.0 -

Oh Mark - now you've made me wet myself:rotfl:
Come on Alberto- you'll have to do a least a little bit of work on this (or hand your claim over to a NWNF company).
So first step is NBA letter. Next is court. It's all in the FAQs on page one.0 -
We had a cancelled flight then had a flight rescheduled 11 hours later, so was looking to claim compensation. We booked the flights through Thomas Cook, but the planes were from Orbest Orizonia Airlines ,anybody any idea who I should make my claim to ?? Any info would be much appreciated0

I wrote to TC asking them for details of the "industrial action" that caused my flight delay and got this response:
"Thank you for contacting Thomas Cook again regarding your flight delay. Unfortunately, I am unable to provide the sort of information you require as I only have the airline's decision to refer to. If you have any further enquiries, I must advise you to contact the CAA as they will be able to take your complaint to the next level."
From what I've seen on the forum it's pointless going to the CAA as they're swamped and a bit toothless anyway.
Should I just go to small claims court on the basis that they've failed to provide proof of their defence?
Thanks,

Yes, basically. You could reply (NBA) and include an excerpt from the court pre action protocols where it states that every effort to divulge reasons should be exchanged between parties in an attempt to keep the matter out of court, for emphasis. (if you like)0 -

Did you write to the airline or the travel agency?0 -

Flightstats shows the plane left 3 hours and 10 minutes late but does not show the arrival time which is the time that counts. Do you have confirmation that the actual arrival time was over 3 hours?
(I was on a flight on Saturday that left 55 minutes late but arrived only 25 minutes late)
No I don't have confirmation of arrival time, but TC are not disagreeing that the flight was over 3 hours late, they're just lying that it was a technical fault when it clearly had nothing whatsoever to do with the plane, the pilot was missing.0
