NF - flight stats seems to show a 7 hour delay on flight from Luton > Malaga ~ does this tie in with your depature delay?0

Yes- we were also delayed 7 hours so that makes total sense and ties in with what we were told at the time. Monarch's letter seems to be deliberately vague so its good to have as much info at hand as possible.

Just wondering if anyone was on this flight

My claim has gone in for the second time (the first was before the decision) but I thought it might be good if we could swap info with other passengers on the flight
i was on the same flight and have sent in all claims forms received letter today 19th feb from monarch with the excuse i expected of extraordinary circumstance the excuse they gave was delay from Sharm el Sheikh because of problems with wing on this aircraft leading to all delays relating to this aircraft. After investigating this excuse i found there eas problems with a flight from Sharm el sheikh but this happened on the 29th sept. Considering our flight was due to depart 30th sept i feel that the company had more than enought time to put something into place in order to avoid delays to other aircraft. There is another point that concerns the usage of extraordinary circumstances as the excuse for our delay the flight was from a non EU country and i dont think under these circumstance it applies I am about to put pen to paper and contact the CAA. Hi pescmy, we were also on that flight and waiting for conclusion to our claim but now i know what its going to be. There were 9 of us in our party so am now going to have a look at what to do to start court proceedings0

is there any no win no fee claim company that is better than others? as pescmy in a thread further up has already had a denied claim for the same flight as ours we are wondering which is the best way to go. dont know really where to start so wondering if losing maybe 25% to a claims company may be easier. do i have to wait for my letter/email or can i make a start now? any advice appreciated, thanks0

Any advice please- complained about delayed flight in writing sent registered post, followed up by email when no response was received following my letter, Monarch sent Eu claim forms which we duly completed, chased them by email after 28 days, today day 30 received a letter by post claiming the delay was extraordinary circumstances and therefore no compensation! What can I do next?0

Go to court or appoint no win/no fee firm however make sure you get the date of your flight correct!0 -

Further to your claim for delay compensation, we are writing to advise the outcome of our investigation into your case.
Monarch Airlines aims as its first priority to provide its passengers with a safe and efficient service. We would like to reassure you that every reasonable effort is made to ensure that our flights depart on time and in the unlikely event we are unable to do so through disruption, we aim to provide a solution at the earliest opportunity.
As previously advised, in some circumstances passengers may be entitled to compensation for delay arising from such disruption under European Union laws. However, any monetary payments are subject to certain criteria being satisfied. Under these laws where the disruption is caused by an ‘extraordinary circumstance’ which the airline was reasonably unable to prevent, the carrier is not obliged to pay compensation. Extraordinary circumstances have been defined by the courts and the European Regulations themselves provide a non-exhaustive list of which circumstances can indeed be categorised as extraordinary.
Our records show that the aircraft scheduled to operate your flight suffered damage to the fuselage during the previous inbound flight. As a result, the aircraft was declared unserviceable and unsafe to fly whilst engineers worked to rectify the fault. In order to minimise the disruption to passengers, an alternative aircraft was despatched to operate the outbound flight from London Gatwick and your subsequent inbound flight. Due to the operating limits of the replacement aircraft, it was necessary to operate via Luxor in order to re-fuel both on the outbound flight, and then your flight. Despite Monarch’s best efforts, these events led to a delay in the scheduled arrival time of your flight.
Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given.

ZB564 Manchester to Tenerife August 17th 2012. Flight delayed for 6 hours due to flat number 2 battery and replacement having to be flown up from Luton. Monarch have just informed me that this was an 'extraordinary circumstance' and therefore does not qualify for compensation.
What I find EXTRAORDINARY is the fact that they do not keep basic supplies such as spare batteries at or near the airport :mad:

My wife and I were on the ZB534 flight to Palma, please see my post #531, 15/02/13. We were originaly told when checking in flight was delayed due to lack of hours with crew, however before we left home on 30/09/12 for airport I checked flight arrival on teletxt and believe the plane coming from Sharm El Sheihk then went to one of Greek Islands before returning to Manchester for our flight, waiting for Monarch to confirm, but if you look on flight stats flight ZB685 from Sharm El Sheihk on 29/09/12 does not show a delay, but Ang216bc has confirmed via this site, posting #564 16/02/13 that the flight did not arrive in Manchester until 10.35 on Sunday 30/09/12, over 12 hours late.
So if the Sharm El Sheihk flight was in Manchester at 10.35 on 30/09/12 where did it go until approx 21.00 hrs??which is time it arrived for ourr flight to board, that is what I want Monarch to answer. Also as you will know we did not actually board this plane as it had another fault and we had to wait another 2 hrs for a flight from Faro to come in then board that plane.0
