Sedge - tell them to Foxtrot Oscar - they are trying to fob you off.

I'd personally refer them to the Pressdram v Arkell case, http://www.nasw.org/users/nbauman/arkell.htm

Credit to Vauban for the link

We have received a letter from Monarch confirming that we are entitled to 400 Euros compensation for the delay on our flight and that the cheque will be with us within 28 days, the payment is just short of £300.

    Flight details are as follows:-

MON 7826 out of Gatwick to Mytilene (Lesvos) on 30 August 2014. The flight was due to depart at 05.35 and eventually left sometime after 11.35. There was an initial delay due to a technical fault. We were due to board at 07.30, with the plane visible at the departure gate but as the crew would then have been out of time an additional delay was caused as they arranged for a replacement crew.

If anyone is maintaining a list of accepted claims please add this to it. Also I am not a Facebook user but if someone wishes to add this to the Facebook site please do so. Not wanting to "count my chickens etc." but have been through lot less hassle than many posters.
Glad to hear you have been awarded compensation.

We were delayed for more than 24 hours in August 2014, flight MON 7918 Gatwick to Preveza, and submitted a claim, but have heard nothing other than an initial email confirming that it was down to a technical fault and we would have to wait to hear etc.

Did you have to hassle them repeatedly?

If you haven't already have a read of Vaubans excellent guide, then issue an NBA. You may have to take Monarch to Court. Letters don't do the trick with Monarch, but if you issue an NBA, then you're giving them fair warning of your intentions.

    Cheers,

In fairness to monarch im hearing of more and more claimants being paid out without resorting to court action, they are working their way through the claims albeit stupidly slowly

They will probably wait till they get the NBA, before you enter the payment queue.

  • Well, having read with some trepidation the lengths to which Vauban had to go to secure compensation, I decided somewhat lazily to try one more throw of the dice before firing off an NBA. I phoned Monarch's Customer service number (0333 003 0700) and asked to be put through to the EU Claims dept.

A very nice young lady asked for my reference number (received via email in December 2014), before informing me that a legal decision has been reached and they are going to raise 3 cheques for myself, my husband and my daughter for the following flight:

    MON7918 Gatwick to Preveza,
scheduled to depart on 24 August 2014 at 06:35 and to arrive 12:00,
actual departure 25 August 2014, actual arrival 14:16.

I'm expecting an email this afternoon to confirm their decision.

    I'll keep you posted.

Been doing some research and the CAA issued a letter of guidance to all airlines in November 2014 stating that they can only use "hidden manufacturing defect" if they have been informed of the defect by the manufacturer. Will this stand up in court do you think?

Yes - I think it would be very helpful. Can you post a link to it?
