Thomas Cook Claim - Settled Monarch Claim - Settled0 -
Don't give up!
We were delayed 8 hours on a flight in December 2008. 2 years ago I started fighting Monarch.
They have tried every trick in the book!
They said it was caused by a "stiffness in the throttle lever" I argued that this was not an EC - on top of this the flight in was delayed by 5hours due to the same tech fault - so I argued this was not an EC but a knock on effect.
5 times they refused to budge.
I followed up and refused to let go of the fight.
I contacted the CAA and twice they lost all my details and I had to start again. Then when the CAA did finally get back to me it was to say that yes I was entitled to compensation but as the time was almost up they were closing the case and couldn't offer any further support the phrase 'as much use as a chocolate fireguard' springs to mind.
Then I had enough going on so decided to hand over to a NWNF company and contacted Bott & Co. They refused to handle the case because they couldn't find the flight!
So I contacted Puckwick Solicitors as I was aware that time was running out. They considerd all the information I already had and agreed to take the case on.
Again Monarch tried every trick in the book to argue their case - they even tried to say they did not recall flying that day
But I provided evidence.
So Pickwick solicitors issued court proceedings before time ran out in December.
Low and behold on monday they offerd to pay out - but offerd £300 less.
We stuck to our guns and said no - pay up!
They have finally agreed to pay the whole amount - so my advice is don't give up - ever - and if you are running out of time issue court proceedings.
It's not about the money after all this time - it's about the principle!0 -
We have received a letter from Monarch confirming that we are entitled to 400 Euros compensation for the delay on our flight and that the cheque will be with us within 28 days, the payment is just short of £300.
Flight details are as follows:-
MON 7826 out of Gatwick to Mytilene (Lesvos) on 30 August 2014. The flight was due to depart at 05.35 and eventually left sometime after 11.35. There was an initial delay due to a technical fault. We were due to board at 07.30, with the plane visible at the departure gate but as the crew would then have been out of time an additional delay was caused as they arranged for a replacement crew.
If anyone is maintaining a list of accepted claims please add this to it. Also I am not a Facebook user but if someone wishes to add this to the Facebook site please do so. Not wanting to "count my chickens etc." but have been through lot less hassle than many posters.0 -
Have just received cheques for 600 euros each following a flight delay of 13+ hours in 2010.
We originally submitted the claim on 2 December 2014 and heard nothing except for standard email reply. Re-submitted the claim on 28 January and 6 weeks later received email notification that the claim was successful.
The flight was MON 2693 from Mombasa to Gatwick on 23 March 2010.
Thanks to Martin Lewis and his team and for all the posts on this forum.0 -
Anyone else find it strange that monarch settle relatively recent claims seemingly quite quickly but then seem to just select some to string along?Determined to save and not squander!

Depends on your definition of 'funny' personally I'm livid with them and wouldn't even be paid to set foot on one of their aircraft ever again!0 -
Generally you will find that if Monarch have already paid out on a flight or/and if a certain NWNF firm are involved they tend to deal with these first as they know they are probably unable to string along for any great period before they are subjected to hearing/interest/attendance costs from the courts.
Where individuals submit a 'weak' claim (say with discrepancies regarding flight number/date etc) they will put obstacles in your way (extraordinary circumstances/manufacturing defect) to dissuade you from claiming.
The manufacturing defect issue is their latest ploy and it appears, to date, the only time they are using this wording is where a delay has occurred to a flight where the plane has now left their fleet!0 -
Only generally. Already paid out on my flight to one claimant who used Bott (Nov 2013) - still no sign of anything for me after signing-up with Bott in December 2013.0

Have you enquired with Bott & Co where your claim is up to ?
If their defence was just an EC then this should not drag on much longer as that defence has, to a massive extent, been removed by the courts. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Received my response in the form of Monarchs defence to court. They are claiming that the engine fault was deemed to be the high pressure compressor blades and as these are not subject to maintenance by monarch and they failed in between the the engine shop visits to the manufacturer that this is a hidden manufacturing defect.
Anyone have any advice?Determined to save and not squander!
