    Short answer - Of course you can start proceedings, you could start by issuing a NBA letter, that gives the airline 14 days to respond, that's time for them to take your claim seriously.

    No judge would think that giving Monarch "only" two months to sort the claim before starting legal action was unreasonable - especially when the airline has had plenty of time to anticipate this development.

    I agree with the Angel that it is only when you start legal action that Monarch seem to take you seriously (a point which applies to many other airlines as well). Though ... don't expect this to be quick. Even if Monarch choose eventually to settle (as they will!) the legal process will take quite a bit of time to roll through it's stages.

    But if Monarch continue to ignore you (and I've seen no evidence of them actually paying up in response to the Supreme Court) then you don't have much of a choice.

    Make that two! Today, on the very last day when Monarch needed to state their defence they still denied liability but agreed to pay the full amount of my court claim. So, judgement accepted and waiting for my cheque. :j

    Bott & Co comment on their Facebook page when questioned regarding the progress of claims against Monarch "........we have heard back from Monarch, but those discussions are commercially sensitive at this time. We would hope to be in a position by the end of next week to provide more of a substantive update on your claim...."
  • That's good news, sounds like Monarch are getting ready to pay, could be that they are discussing the interest element of the claims.....

    It seems monarch are requesting that cases be stayed on the basis they have 900 odd litigated claims, they also however throw in a few lines about ambiguity in decisions etc just to try and throw a spanner in the works

    Just read info on the Monarch Complaints Facebook page, looks like Monarch are not going to pay out under their own stream, week 5 now and still no info so I think I have been fair as my email came 3 weeks after i submitted my claim and a confirmation letter within 2 days, two weeks later I got the email everyone got stating from the date of the letter so in theory they have had 7 weeks so far.
    If nothing by the end of next week then a NBA goes in, I will take them on in court and show the judge all the correspondance, they have had more than enough time.
