    They referred me to the UK dept of the EEC, who in turn referred me to AESA in Spain, and so it goes on being passed from pillar to post. Has anyone else had this problem when their delay was from a Spanish airport to the UK?

    I personally found the AESA extremely helpful and they ruled in my favour, however Jet2 completely ignored this ruling and indeed, any decision they make is not enforceable in the UK Court system so I have to agree with JP

    I have been assisting two separate parties regarding Monarch claims (neither party has commenced court action yet despite my advise!) - following telephone calls over the past couple of days one claimant has been advised by their EU claims team that his claim is unlikely to be looked into until February 2015 and the second claimant has been informed of a March 2015 consideration date.

    I don't mean this to sound harsh, but the airlines are only unreasonable because they are allowed to be so. Not only by the CAA, but by the claimant. If folk are not prepared to take legal action, then expect your claim to be at the bottom of the pile - if you're lucky. Not give the airline the opportunity to mess you about, is my advice. The law is unambiguously on your side in most cases, so use it!
  • Hi all

    Apologies if this has already been addressed....

    I am taking Monarch to the small claims court. This was put on hold by Monarch pending Huzar and I have yet to hear anything from Monarch or the court, even though the Huzar decision was over a month ago.

    I've seen the other posts that Monarch are asking for more time in general, but I have had no contact at all.

    Is there anything I can do to push this along?

    Yes. Contact the Court and ask them to lift the stay. If you dont take action, no one else is likely to.

    Fairs may go up but even one of the other airlines (Jet2) have admitted fares will only rise by 50p per passenger per flight if they meet all their claims and they are as useless as Monarch in respect of 261/2004 - fair play to you though at least you gave an opinion.

  • so phoned them this morning just for the craic, they are apparently reviewing flights in order of number of claims per flight, What !!!!!!!! is that? never mind people waiting years

    She also waffled that the law had changed, told her nonsense the law has been the same for years
