Thanks for the info..We would also advise that Monarch are currently in bottom place in respect of sorting out claims/acknowledging the law.
I'm not sure that I'd put Monarch at the very bottom of the list of the very worst in sorting claims, surely that accolade belongs to Jet2 :beer:After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I just spoke to the claims department, I was told that the legal team have started paying out, and based on the number of complaints per flight would determine the order of flight payouts - she also said that the team were working hard to make most of the payments before christmas but the complicated complaints could take as long as March! Not sure this will help anyone but thought i'd share my update!0

I'm afraid I simply don't believe this from Monarch. The latest update from Bott gives a very different picture.0

The situation as I understand it at Monarch is ...
1) The priority is to deal with those claims which are already in the court process. This makes sense really so that Monarch (if they are going to pay out on these) are not lumbered with the additional interest costs, court attendance costs etc.
2) Monarch have requested an additional 13 weeks from the courts in order to deal with their excessive work load. This is a joke as firstly they should have been looking into these claims ages ago plus the 13 weeks they have requested should be added to the 5 weeks since the Huzar appeal determination ie Monarch are saying it will take over 4 months to respond to court cases.
3) Monarch wrote to most claimants saying their claim should be resolved within 6 weeks - it is apparent this will not happen.
4) The paralegal who replaced Callum Blumire seems to understand and appreciate the need for some urgency however at the end of the day she answers to the head of legal services who still appears to 'control' the situation and who appears to have a different attitude to her paralegal.
5) Whilst some claims are being settled (whether the court is involved or not) Monarch are painfully slow and in my opinion the only way to achieve a positive result is to instigate court action. You may get a positive result by following the Monarch claim process however indications at this moment in time are that your chances are very slim.0 -
I think this is very sound advice from the KAB, whom I know has some insights into this situation. It seems increasingly clear that Monarch have no interest in paying people what they are owed speedily, if at all. The legal option is all that remains.0

Received an email from Monarch yesterday to say they've accepted my claim for a delay on MON1829 Corfu to Manchester 02nd June 2014. Should receive cheques for both myself and my wife within 28 days.
Have to say this is my second claim with Monarch this year having claimed for a delay on MON1829 Corfu to Manchester 4th June 2012 and in both cases Monarch have paid out without any question and except for the delay caused by the wait for the Supreme Court Judgement they've settled promptly.0 -

ive just had a letter for my claim it has been allocated to a court hearing on the 9th jan, so no more stays from monarch, quite looking forward to fighting this out in court! if they turn up that is!0

"Monarch
On Monday 1st December 2014 we held a conference call with Monarch’s in-house legal team to get some reassurance that they are reviewing claims as quickly as possible. We wanted them to commit to reviewing a fixed number of claims per week going forward, however unfortunately Monarch were unwilling to provide any such commitment.
Monarch explained that they are prioritising claims where court proceedings have been issued and where the courts have written to them asking them to explain why their defence should not be ‘struck out’ (if a defence is struck out it means the other side automatically wins their case). Unfortunately this reactive, rather than proactive, approach means it’s difficult to see how Monarch will be reviewing the bulk of claims in a timely manner.
We have therefore put Monarch on notice that if we do not see a significant improvement by Monday 8th December 2014 then we will be pushing ahead with court proceedings.
The obvious advantage to issuing court proceedings is that Monarch then have a fixed deadline for dealing with a given claim, otherwise they automatically lose the case.
We hope for Monarch’s sake that they will demonstrate over the coming week their commitment to settling passengers’ claims without any further unnecessary delays."Posts are not advice and must not be relied upon.0 -
Am new to this forum but wanted to tell you about my experiences with my claim to Monarch over a delayed flight from Palma to Manchester on 28/9/2014. Claim was rejected by Monarch on 28/10/2014 stating 'exceptional circumstances' even though the cause was a technical fault. As advised on this site, contacted the CAA, but because flight was from Palma, advised to contact the European Consumer Centre in Spain (difficult because most of the online info is in Spanish!) They referred me to the UK dept of the EEC, who in turn referred me to AESA in Spain, and so it goes on being passed from pillar to post. Has anyone else had this problem when their delay was from a Spanish airport to the UK?0
