    Further update....

    An email from Monarch today has put my claim on hold pending the Supreme Court decision. I understand the Huzar case is based on a technical delay. I claimed denied boarding based on an operational decision that Monarch made to send my plane elsewhere the previous evening. So there wasn't a technical delay as the plane was simply not at the gate but was able to fly, technically. Worth persisting with on this basis?

    The only way you can persist with this is to take court action and hope to convince the judge regarding the operational aspect.

    I wrote back refuting their assumption it was "a technical delay". CAA escalation first?

    NO NO NO !!!! Do not involve the CAA the toothless, worthless, useless, airline funded organisation. The new boss of Monarch (Roy McNulty) was former chair of the CAA so imagine where his allegiance lies. Wait for the results of Huzar if you wish but if not court action (either under own steam or via a NWNF) is all you can really do.

    Your post seems to be of an identical issue as ours, we submitted our claim for a flt delay. in oct 2012 mc/sharm.
    Were new to this, would appreciate any info/help if available.

  • Arrived at Larnaca apt at 12.00 for our 14.40 flight to Luton to find the flight was delayed 10 hrs, the reason given the aircraft on a previous flight was delayed ect ect.When I went to pick up my car from the long term car park at luton I had to pay £14 pounds to get my car out for overstaying, I was not happy.
    I fired a letter off to Monarch asking for the £14 pounds as it was down to them I had got charged this.I received a nice letter back saying we don,t have to pay you anything but offering two £50 vouchers off my next flight with them.It was at this time I read about the EC ruling so I wrote back saying that they were liable for out of pocket expenses and that did,nt want their vouchers I was claiming compensation under the EC ruling.I checked up on flight stats and found the aircraft left for Gibraltar at 09.15 2hrs after it should have left for Larnaca.Monarch had stated that on its previous flight the pilot had become incapacitated and the weather(fog) had delayed the flight.
    I decided to engage a nwnf co. used EUDELAY I found them to be very good always replied the same day to any emails I sent or could talk to them on the phone.
    Day before court Monarch conceded agreed to pay compensation £773 inc court costs- £125 EUDELAY,s charge very reasonable they also payed the excess parking charge. :beer:
  • Please add this to the list of delayed flights. Technical fault-wing flap sticky, but delay due to crew needing to rest. Plane flew back to UK empty?
    This i now with the Courts and Monarch have defended siting exceptional circumstances, I will update when there is news.

    Was refused by airline, then went to CAA, it came back the same refusal. I've just asked CAA to reopen case yesterday and yesterday I got an email agreeing with me and Monarch has agreed to pay!

    Also yesterday I had sent all my information over to the nice lady at pickwicks solicitors (who seem cheaper than most) who was really helpful. She was going to deal with my case, obviously not needed now.

    I'm claiming for the return flight ZB685 from Sharm el Sheik 29/06/2013 to Manchester. I've also been through the CAA and got nothing and raised a small claim. Monarch are going to contend the case. Please can you give me as much information as you have so that I can be prepared,
    I'd really appreciate your help,
