    You have not done anything wrong, we all reccomend you read the faqs on page 1 of each of the different airline delay forums, this gives you infomation and links on how to proceed with your claim. Unfortunatley the airline do not like playing ball at the moment so you will need to take it further. Many of the members on here have had all the same brick walls and info sent to them from the airlines
    It is not what you may think despite the press and media saying you can claim, just put a letter in, there is a lot more too it than that I am affraid.

    Having successfully won compensation for my delayed MON1829 flight, Corfu to Manchester on 4/6/12 (still waiting for the cheque though) I have today submitted a claim for MON1829, Corfu to Manchester on 2/6/14 which was delayed by 4 hours 20 minutes. Hopefully the outcome will be the same although I suspect I might have to fight them over this one as it's new and undoubtedly not been to the CAA or court yet.

    I am currently in the process of a compensation claim for this flight on Friday 17/09/10 but on checking with Flightstats, it doesn't give any information on flight status.The flight was cancelled/delayed for 24 hours and we eventually flew the next day (Monarch put us up in the Lake Mary Marriott).Has anyone out there also got a claim pending or know how I can get any more info on the delay?We were told that the plane had gone tech.

  • I've received compensation for the following flight and thought I would post as I probably wouldn't have taken any action without this site.

    ZB519 Barcelona to Manchester on 12/08/12
    (the night of the closing ceremony of the Olympics)

    The flight was delayed by 5 hours. I followed Monarch's procedure and they came back with Exceptional Circumstances in denying the claim- to quote

    "Our records show that due to an aircraft with an overspeed protection fault, there were insufficient aircraft from within our fleet to operate your flight on time. Therefore your flight was unavoidably delayed, however, in order to reduce the delay, we transferred passengers to the first available aircraft from within the Monarch fleet.

    Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given."

    I went back to them and got no further. I thought about the small claims court but for ease I went with a flight claims specialist whom I'd seen on the local BBC news as they were fighting a case at the High Court in London. ( I won't name the firm here but I was obviously pleased with their success)

    After sending them all the info and waiting the statutory time, Monarch didn't respond. The company followed up and within a week Monarch accepted the claim. A couple of weeks later the compensation was in the bank. Yes - the company takes a 25% cut - but it did save me the hassle of going to court which I considered was worth this.

    While I'm all for people submitting claims themselves - when you're up against a company that will use EC to get out of most - it may be wise to use a company at no risk to yourself and for what i considered a reasonable cost.

    If someone could add this flight to the list of successful claims then others should be able to claim direct now as Monarch has paid out on this flight. And if any have been denied for the same reason - I can't see why they shouldn't pay out on these flights too.:j

    Heard back from Monarch who say they will not progress my claim until the Jet2 appeal is heard by the Supreme Court which Monarch reckon won't be until October at the earliest.
  • They are just using yet another delaying tactic!
