    With Monarch I'm afraid the only way is court. You have issued your NBA (presume 14 days) so court under your own steam or via a NWNF.     I tried them, must be doing something wrong, its my young cousins flight, was 28 june last year from Manchester to ~Sanforfd....... he has no paperwork apart from the lugage tag for the return flight which was MON0302.....

    I ahve tried but was just gettign nothing, which is why i asked you clever guys :) and thanks

    Don't think you are doing anything wrong as Monarch charter flights do not always appear on flightstats so if you are fairly sure delay was 3 hours plus then submit claim to Monarch and go from there.
  • Depends what you mean by costs?

    If you mean can they claim the standard court attendance fee plus their reasonable travel costs to and from court, then yes.

    Does anyone know if this have ever been imposed and if so, approx what costs?

    I think this is something (if imposed) that needs to be put into the equation when deciding if to take the airline to court.

    Jet2 didn't seek costs against me and judge didn't offer, when I lost.

    Monarch asked the Judge in our case in July when we won, and he refused....but think like manyother things it is down to the individual on the day....

    our judge was spot on, he pointed out the new rules that came into force early in the spring where it had to be a level playing filed and that if one part stuck to the court guidelines for submission then both parties had to and as they hadn't defence not allowed.... followed by........it was a very weak on anyway.....lol.

    Paperwork with the court bailiffs as Monarch have failed to make payment so far...:):)

    Thanks, oh yes delay was over 4 hours :) was just hoping to be able to track down something to confirm it,:D

    Monarch will soon tell you if they think you are wrong! But don't believe [STRIKE]everything[/STRIKE] (anything?) they say :)

    Don't suppose there's a link to that LBD is there?
    I mean court 'new rules' about being more strict about documentation being submitted on time, not 'new rules' from the NEB's regarding EC's.

    Mark our Judge in July refereed to the new Spring ones, so here is the link I think he might be referring too...
