Good Luck with Flightmole! Out of interest- did you see if EUclaim would take your case - I put in my details out of curiosity (still waiting on a decision!) and it came back that they wouldn't take it on. I'm just wondering if they know something I don't....
Would be interested to see if Mark's claim WOULD be taken on if he inputted his flight details

I actually started with euclaim a while ago when monarch wouldn't entertain my claim while waiting on the appeal, but I withdraw from them somewhat foolishly thinking monarch were processing my claim, but they never responded when i asked if they were willing to take it on again, so i went to flightmole. if I input my flight details on euclaim now they will accept it. But it's pretty much the same percentage as flight mole anyway.

What is your claim that they won't accept?

"Based on an analysis of the official arrival and departure times, you possibly qualify for a financial compensation. We have investigated this flight and concluded we will not be able to successfully pursue this claim for you. Click on the product of your choice below to file the claim yourself"

The above is what the result is if you input my flight details -
Flight: ZB692 Manchester to Mahon 3 June 2011

All I know so far is its a technical fault....filed with Monarch in early Nov.

Maybe it's a good sign that they are willing to take yours...on the face of it at least...

People's patience here never ceases to amaze me. At the risk of stating the obvious, 14 days' notice is all you need either to agree settlement or issue a claim. If they insist they need more time to obtain reports and data on your flight, then another 7-14 days is more than enough.

Get suing!

What you have to appear for the purposes of the court system is "reasonable" and that you have exhausted all avenues prior to instigating court action...

It shows how unreasonable they are being, which is only good for your court claim.....just my own personal experience...

If you just submit a claim for compensation with a 7-14 day deadline and get no response and then submit a ccc, you could be viewed as unreasonable...

which is why some of us have been so lax and given so long

EUclaim are showing my flight as cancelled, although it was a 26 hour delay I think it wasnt officially cancelled, so maybe that is the difference

Of course you're quite right in saying that reasonableness is an important concept when bringing a claim. The court's own definition of a reasonable timescale for a full response is derived from the Practice Direction on Pre-action Conduct issued by the Ministry of Justice. The 14 day deadline comes from this, and so does the further deadline of up to another 14 days if the defendant requires it.

The CPR definitions and what a sitting magistrate sees as "reasonable" may well be two totally different things....

Again the courts own CPR are there for all to read and see, but the court does not always apply them.....

for example the bank charges, there were a great many people who submitted trial bundles to both the court and the defendant prior to or on last day of service.....the defendant did not....under the courts own rules the defence should have been struck out and judgment awarded to the claimant due to the failure to comply with the courts own rules and deadlines, it did not happen..

A great deal dependent on the judge/magistrate, and I can see this going the same way... it is all down to how each individual interputates "reasonable"...

Individual judges coming to different conclusions - surely that should be seen as unreasonable ;)

Do you mean for me to make an initial enquiry *as if* I want to proceed?

After hearing nothing for five weeks I have today sent off Court forms. A further letter has been sent to CAA and a second one to Egypts equivalent (this time in Arabic).
I am away for a few weeks from Saturday (not flying with Monarch) and hopefully I will come home to kind of response.
I will inform the Forum of any developments.
Good luck to all claimants in whichever road they decide to go down.
I work in customer relations myself and consider the lack of information/action from Monarch to be nothing short of disgusting.

got this from the CAA today, (sent email before i passed to flightmole)

Thank you for your further e-mail about your airline complaint.

Due to a recent Court Of Justice of the European Union (CJEU) passenger rights ruling, we are experiencing a heavy demand for our services. Unfortunately this means us taking much longer to reply to complaints than we would wish.

From the date on this letter, it will take us approximately 20 weeks to reply to you about your original complaint. We are grateful for your patience in waiting for us to get back to you. Please accept our sincere apologies for this delay.
