Well of course they can demand it. Just as I can demand that all the people on this forum address me as Professor, the Lord Vauban. But frankly neither stipulation is likely to be observed, as both are equally absurd.
It is an interesting addition to the standard template letter though. Sounds like Monarch don't like us talking about 'em and swapping notes. Treat your customers better and we won't have to!
Of course they don't like us swapping notes. I was wondering if airlines could claim copyright infringement against customers who reproduce their letters on this forum, as they own the copyright to their letters. However, what's the maximum they can claim under copyright laws? Royalties? It's not as if they could sell their letters!0 -

Airline bust= no claim
The claim is against the airline, not the travel agent, not the package holiday company, not the administrator, nor anyone else. AIRLINE ONLY. If the airline is bust, you have no-one to claim against. It doesn't matter if the package tour operator is still in business and the airline is not. No airline = no claim.
Anything from 17th Feb 2005 -you can claim but if the airline says no - you can't take them to court.... but check out the corrections to the (inaccurate) MSE article:

Young cousin flew out has no paperwork for outbound but luggage label from return....I tried flight stats, but am getting nothing, am I ,missing something really obvious and simple????0 -

You were probably on ZB305 on 9th June (11 hour delay) or 16th June (3 hour delay).
If it's the 9th June then I've already seen a response from Monarch saying the delay was due to a technical fault with the engine.0 -
Today I have had the pleasure of going through the Mediation process with Monarch.
I made my case to mediation that from start to finish in dealing with Monarch it has been dreadful. Abandoned at airport in Spain - no help or assistance - minimal food/drink. No access to phone, fail to issue with notice re rights, etc.
5 letters to Monarch - not one answered - so all pre court protocol done.
Extraordinary Circumstances used by airline for a blown fuse inbound on the PA System.
During mediation - Ms Mullay quoted from the preliminary list of EC`s published after the NEB meeting on 12 Apr 2013. Items 24 & 26 from this list which deal with faults found in pre flight checks, and failure of on-condition/condition monitored parts.
I explained to the mediator that the document referred to is NOT LAW, it is for information and guidance only. This was countered that it was being used in courts up and down the country so judges can be given some clarification on what is an Extraordinary Circumstances.
My response was - go ahead and use it in court if that is your defense.
I was offered a cash amount which was derisory.
So now waiting for my court date in Oct/Nov.
I`m just glad I have used this site to pick up on all the useful bits of info and for that I give thanks to all the contributors.0
