    There will always be genuine extraordinary circumstances - weather, strikes, passenger illness in flight etc - however as previous posters have commented, the airlines have had 8 years to put procedures in place to ensure that NON-extraordinary delays are dealt with within the 3 hour deadline before the passenger's legal right to compensation kicks in.

    A delay under any circumstances is not pleasant however what compounds the problem, as Vauban comments above, is the complete lack of customer care shown at both the time of the delay and the time since. On the day of the delay we were left to fend for ourselves with no further information or any Monarch reps forthcoming; since complaining to them, they took 5 months to respond to my initial complaint, were late submitting court papers, and then sent along a barrister who had clearly only just been instructed. Had Monarch treated us with respect at any point during the process we would have been far less inclined to pursue to the court stage; however, as time went on it became less about the amount of compensation, and more about proving a point.

    Monarch must surely wake up soon and realise what a complete PR disaster this is. Word of mouth - and social networks - is immensely powerful.

    I am due in court soon with Monarch and submitted my papers 14 days prior to the hearing as requested.

    Do Monarch also have to submit papers? I am yet to receive anything from them?

    Or was there defense that I saw months ago everything I will receive from them?

    They should serve (send) you their defence normally at least 14 days before the hearing although in Vauban's case the Judge went for a 6 week lead in period. It is imperative if you have not received their defence within the stated period that you contact your local court to advise as they may well find in your favour prior to or at the hearing.
    Monarch love playing this 'trick' - sometimes they send to the Court and conveniently forget to send to you - check this with the Court as well.

    2... Post 2264 says there's a list of all claims (good. bad & ugly)... why not share.. either on forum or via PM?

    3... You don't have any loyalty to Monarch (presume no longer work for them)

    4... You don't care about Monarch (again presuming the obvious)

    5... as highlighted in red above.

    Hell Aedus, why not help out where you think individuals (you judge) have been wronged?

    It sound from what you said that you do/did have some clout, as a mere claims advisor (no disrespect to anyone as I did work for an insurance company ;)) you would not have any persuasion unless you held a high stance.

    You said yourself that Monarch gone bad..... so be a SUPER HERO and help out :rotfl:

    I did receive a defense from Monarch maybe 2 months ago. Is this a more comprehensive defense I should have received?

    We are due in court this week!!

    You should get in touch with the court immediately to say that you have not been provided with Monarch's bundle of papers, and to check whether the Court has been given them.

    These are the papers that Monarch will rely on to argue their case in court. So it is important you have enough time to consider them (you've sent Monarch your papers, presumably?).

    This is disgraceful practice by Monarch - if unsurprising.

    Very angry with Monarch as if they are being sneaky and have sent to the court only, then if the case does go ahead, we wont have had any time at all to consider the papers which doesn't seem fair!

    Very frustrating...

    Monarch are not fair - devious in all their actions in respect of Court claim defence. Make sure you point out to the Court ASAP however reaction depends upon their attitude to late/no delivery of information/defence from Monarch. In my case the judge just overlooked it (still awarded in my favour) however in one recent case he threw Monarch's defence out as he just wasn't accepting a late submission.
  • I will call the court first thing. I know I am jumping the gun here, but if they do overlook this, do you think it appropriate to raise that this happened when in court?
